RESOLUTION No. 480 92 -
RESOLUTION OF THE COUNTY COUNCIL OF THE COUNTY OF HAWAII
AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH NANSAY
HAWAII.
WHEREAS, by virtue of Section 46-15, Hawaii Revised Statutes
(HRS), as amended, and by the regulations related thereto, the
County is empowered to develop real property, either itself, or
on behalf of the State of Hawaii, or in partnership with
qualified developers or contractors; and
WHEREAS, by virtue of Chapter 2, Article 13, Section 2-70,
of the Hawaii County Code of the County of Hawaii, the County is
empowered to develop and construct dwelling units, alone or in
partnership with developers or contractors; and
WHEREAS, the County hereby acknowledges that Nansay Hawaii
(hereinafter called Developer) is an acceptable and qualified
partner in satisfaction of the requirements of Chapter 2,
Article 13, Section 2-70, of the Hawaii County Code; and
WHEREAS, the County hereby acknowledges that the County and
the Developer will be developing multi-family zoned land in
Waikoloa Village, South Kohala, Hawaii, more specifically
identified as a portion of TMK: 6-8-002: 26; and
WHEREAS, the County's Office of Housing and Community
Development (hereinafter called "OHCD") desires to subdivide said
land to provide decent, safe, and sanitary housing to qualified
individuals; and
WHEREAS, on June 3, 1992, the Hawaii County Council adopted
Resolution No. 462-92 authorizing the Finance Director to
negotiate the sale, in fee-simple, to the Hawaii Housing
Authority for the development of affordable rental units at a
price that does not include land value and recovers the site's
prorated share of "backbone" infrastructure cost.
WHEREAS, the Developer has made available funds for survey
and other authorized costs as determined by the County for
subdivision and development of said land; and
WHEREAS, the County desires to use its funds to provide
decent, safe, affordable housing for individuals and families of
West Hawaii, County of Hawaii; and
WIiEREAS, the Developer and the County mutually desire to
combine their resources to meet their mutual objectives as set
forth herein.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that the Mayor or her authorized representative is
hereby authorized to enter into an agreement with Nansay Hawaii
to provide affordable housing for the residents of the County of
Hawaii.
BE IT FURTHER RESOLVED, that the Housing Administrator is
hereby authorized to execute other related documents and to take
any and all action necessary to hasten the completion of the
project or substantially reduce its cost.
BE IT FURTHER RESOLVED, that copies of this Resolution be
sent to Nansay Hawaii and the Administrator of the Office of
Housing and Community Development of the County of Hawaii.
