RESOLUTION OF THE COUNTY COUNCIL OF THE COUNTY OF HAWAII
AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH WAIKOLOA
HEIGHTS INVESTMENT PARTNERS.
WHEREAS, by virtue of Section 46-15, Hawaii Revised Statutes
(HRS), as amended, and by the regulations related thereto, the
County is empowered to develop real property, either itself, or
on behalf of the State of Hawaii, or in partnership with
qualified developers or contractors; and
WHEREAS, by virtue of Chapter 2, Article 13, Section 2-70,
of the Hawaii County Code of the County of Hawaii, the County is
empowered to develop and construct dwelling units, alone or in
partnership with developers or contractors; and
WHEREAS, the County hereby acknowledges that the Waikoloa
Heights Investment Partners (hereinafter called WHIP) is an
acceptable and qualified partner in satisfaction of the
requirements of Chapter 2, Article 13, Section 2-70, of the
Hawaii County Code; and
WHEREAS, the County hereby acknowledges that the County and
WHIP have infrastructure requirements that affect each other; and
WHEREAS, WHIP desires to develop properly zoned lands in
Waikoloa Village, South Kohala, Hawaii, identified as a
TMK: 6-8-002: Por. 22; and
WHEREAS, the County's Office of Housing and Community
Development (hereinafter called "OHCD") desires to develop land
in Waikoloa Village, South Kohala, Hawaii, identified as
TMK: 6-8-002: Por. 26, to provide decent, safe, and sanitary
housing to qualified individuals; and
WHEREAS, the County and WHIP have made funds available for
the development of a l0 MV electrical substation, electrical
transmission lines, drainage diversion(s), water transmission
lines, and sewer transmission lines with costs as determined by
the County and WHIP to be of mutual benefit to each other; and
WHEREAS, the County desires to provide off-site
infrastructure through property owned by WHIP to develop the
Waikoloa Village Affordable Housing Project; and
WHEREAS, WHIP desires to provide off-site infrastructure
through property owned by the County to develop the Waikoloa
Heights Project; and
WHEREAS, WHIP and the County mutually desire to combine
their resources to meet their mutual objectives as set forth
herein.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that the Mayor or her authorized representative is
hereby authorized to enter into an agreement, as embodied in
concept by the attached agreement and implementing documents,
with Waikoloa Heights Investment Partners to provide affordable
housing for the residents of the County of Hawaii.
BE IT FURTHER RESOLVED, that the Housing Administrator is
hereby authorized to execute implementing documents to assure the
completion of the on- and off-site infrastructure and to take any
and all action necessary to hasten the completion of the project
or substantially reduce its cost.
BE IT FURTHER RESOLVED, that copies of this Resolution be
sent to Waikoloa Heights Investment Partners and the
Administrator of the Office of Housing and Community Development
of the County of Hawaii.
