RESOLUTION N0. 503 92
AUTHORIZING THE NEGOTIATION AND EXECUTION OF AN AGREEMENT WITH
WHITE HAT DEVELOPMENT CORPORATION FOR WATER COMMITMENTS FOR
AFFORDABLE HOUSING UNITS AT MAKAULA, NORTH KONA, HAWAII.
WHEREAS, the White Hat Development Corporation (hereinafter
"White Hat") has been working to develop an affordable housing
project (hereinafter University Heights) on land at Makaula,
North Kona, Hawaii, and identified as TMK: 7-3-3: 7 & 17 to
provide decent, safe, and sanitary housing to qualified
individuals of the County of Hawaii; and
WHEREAS, the Office of Housing and Community Development
(hereinafter "OHCD") has been working with White Hat to develop
this project; and
WHEREAS, the OHCD has an agreement with the Department of
Water Supply (hereinafter "DWS") to provide units of water to
affordable housing projects so designated by the OHCD and the
Hawaii County Housing Agency (hereinafter "HCHA"); and
WHEREAS, the County is authorized to enter into agreements
with other entities to assist in the development of affordable
housing; and
WHEREAS, the OHCD has determined that: (1) White Hat is an
acceptable and qualified entity with which to enter into an
agreement, and (2) the Makaula, Kona, area is a good and proper
choice for an affordable housing development; and
WHEREAS, the County and White Hat desire to enter into an
agreement to designate the project as an affordable project and
provide it with water commitments.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that the Housing Administrator of the County of Hawaii
is hereby authorized to negotiate and the Mayor is hereby
authorized to execute an agreement that the County of Hawaii will
provide 109 units of water for that development; and White Hat
will provide 109 units of affordable housing.
BE IT FURTHER RESOLVED, that the Housing Administrator is
hereby authorized to provide such additional information as may
be required and to act as the authorized representative of the
Hawaii County Housing Agency in connection with the development
of University Heights.

SUBJECT: Resolution for the Hawaii County Council
Agreement with White Hat Development Corporation
The Office of Housing and Community Development (OHCD) has
submitted to the Hawaii County Housing Agency (HCHA) a resolution
authorizing the negotiation and execution of an agreement with
White Hat Development Corporation for water commitments for
affordable housing units at Makaula, North Kona, Hawaii.
The HCHA has reviewed and approved the resolution at its meeting
of August 5, 1992. Accordingly, I am requesting that the
resolution be included on the Council agenda for action at its
August 19, 1992, meeting.
