HomeMy WebLinkAboutRES 506 Draft 02 1988-1992COUNTY OF HAWAH ` STATE OF HAWAII RESOLUTION N0. 5Q6 92 (DRAFT 2) P7HF,REAS, Chapter 2, Article 19, Section 2-114, Hawaii County Code, as amended, provides that real property may be sold or leased through negotiation upon a finding by the council that the public interest demands it; and WHEREAS, Chapter 2, Article 19, Section 2-170(a) and (a)(2), Hawaii County Code, as amended, provides that notwithstanding any limitations to the contrary, the council may, by resolution approved by a majority of its members, direct the finance director to negotiate the disposition of real property by leasing it to governments, governmental agencies, nonprofit organizations, or affordable housing developers at such rentals and on such terms and conditions as deemed proper; and WHEREAS, the Hawaii County Economic Opportunity Council, a nonprofit corporation organized under the laws of the State of Hawaii., is a recognized childcare provider authorized to operate childcare programs f.or preschool children of low-income families; and WHEREAS, a childcare facility will he constructed by the State of Hawaii and "turn-keyed" to the County of Hawaii for operation as a childcare facility and community center; and WHEREAS, the childcare facility will be maintained and operated by HCEOC and the community center will he maintained and operated by the Department of Parks and Recreation; and WHEREAS, the County of Hawaii desires to enter into a twenty (20) year lease agreement with the Hawaii County Economic Opportunity Council for maintenance and operation of a childcare facility at Clem Akina Park, Puueo, South Hilo, Hawaii for $1.00 a year. NOW, THEREFORE, BE IT RESOLVED by the Council of the County of Hawaii that the Finance Director is hereby authorized to negotiate a lease with the Hawaii County Economic Opportunity Council for the purpose of operating a childcare program for preschool children of low-income families, for $1.00 a year. BE IT FURTHER RESOLVED that the lease be submitted to the Council for review and subject to Council. approval.
