HomeMy WebLinkAboutRES 524 Draft 02 1988-1992COUNTY OF HAWAII: STATE OF HAWAII RESOLUTION N0. 524 92 (Draft 2) WHEREAS, Waikoloa Development and Waikoloa Land Company have indicated their willingness to enter into an agreement with the County of Hawaii; and WHEREAS, Waikoloa Development and Waikoloa Land Company offers to lease to the County of Hawaii, their Highlands office located on Lot 1, File Plan 1209, being TMK: 6-8-03:19, at the rate of $1.00 per year for use as a temporary fire and rescue facility; and WHEREAS, The lease of the above mentioned property will begin on January 1, 1993 through December 31, 1997, or until the permanent facility is completed in the Waikoloa area, whichever is sooner; and WHEREAS, Waikoloa Development and Waikoloa Land Company have pledged a contribution of $30,000.00 to be applied toward the costs of renovation of the existing building and addition of the equipment garage; and WHEREAS, the amount of $132,0.00.00 of lost rent revenues combined with the contribution of $30,000.00 as stated above shall satisfy Waikoloa Development Company's requirements under police and fire related conditions of the state land use and county zoning existing at this time; and WHEREAS, Waikoloa Village Association has committed $20,000.00 designated for the construction of, and the volunteer personnel for the building completion of the Waikoloa temporary fire station; and WHEREAS, The County will be responsible for all real property taxes for Lot 1, File Plan 1209, being TMK: 6-8-03:19, which presently amounts to approximately $3,500.00 a year for the duration of the lease, beginning on January 1, 1993 through December 31, 1997, or until the permanent facility is completed, whichever is sooner; and WHEREAS, The County will indemnify Waikoloa Development and Waikoloa Land Company throughout the term of the lease against any claims resulting from the County's use of the leased premises, excepting those claims arising from the negligent actions of Waikoloa Development and Waikoloa Land Company; and WHEREAS, The County will provide 24-hour basic life support medical and fire engine teams beginning January 1, 1993 until proper personnel are trained; and WHEREAS, Waikoloa Development and Waikoloa Land Company is requesting that the County diligently pursue construction of the permanent facility prior to the expiration of the term of the lease on December 31, 1997; and NOW, THEREFORE, BE IT RESOLVED THAT THE COUNCIL OF THE COUNTY OF HAWAII request of the Honorable Lorraine R. Inouye, Mayor, to acknowledge and expedite the agreement of lease with Waikoloa Development and Waikoloa Land Company, for the temporary fire and rescue facility in Waikoloa located on Lot 1, File Plan 1209, being TMK 6-8-03:19, at the rate of $1.00 per year beginning on January 1, 1993 through December 31, 1997, or until a permanent facility is completed in the Waikoloa area, whichever is sooner. BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the Honorable Lorraine R. Inouye, Mayor, County of Hawaii and Mr. Thos Rohr, President, Waikoloa Land Company, Dated at Hilo, Hawaii, this 21st day of October , 1992.
