HomeMy WebLinkAboutRES 533 Draft 02 1988-1992COUNTY OF HAWAII STATE OF HAWAII RESOLUTION N0. 53,E Sz (DRAFT 2) WHEREAS, the County of Hawaii, through its Housing Agency's goals and objectives, has established as one of its housing goals to promote new, innovative, and flexible housing developments to meet the changing needs of residents; and WHEREAS, the Hawaii County Council, on August 21, 1991, has adopted Resolution No. 364-91, designating areas of land in Waikoloa, South Kohala (more specifically, Lot 5 of File Plan 2038), for experimental and demonstration housing projects, pursuant to Section 46-15 of the Hawaii Revised Statutes (HRS); and WHEREAS, Nansay Hawaii, Inc. (hereinafter Nansay), and the Hawaii Housing Authority proposes a three (3) project, low-income multi-family rental development on Site No. 19 (Exhibit "A"); and WHEREAS, Site No. 19 has been determined to be suitable and desirable for multi-family residential development; and WHEREAS, Site No. 19 is approximately twelve (12) acres in size and is generally described in the master plan prepared by Nansay; and WHEREAS, on August 20, 1992, the County of Hawaii and Nansay entered into a joint-venture agreement which gives Nansay the responsibility of subdividing Site No. 19 for the multi-family projects and to develop related on- and off-site infrastructure improvements; and WHEREAS, the County of Hawaii and Nansay have determined that certain preemptions are required to keep the cost for the proposed multi-family rental projects affordable. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Mayor is hereby authorized to designate the Housing Administrator of the County of Hawaii to serve as the designated County official to administer this experimental and demonstration low-income multi-family rental project (Ke Kumu), as provided by Section 46-15 HRS. BE IT FURTHER RESOLVED that the Housing Administrator be authorized to grant preemptions to code, construction, and subdivision bonding and improvement requirements as identified in the hereto attached Exhibit "B" BE IT FURTHER RESOLVED that the County Clerk be directed to forward true copies of this Resolution to Nansay Hawaii, Inc., and the Office of Housing and Community Development. 1992. Subdivision Chapter 23, Division 4, Section 23-41 (Hawaii County Code); Minimum right-of-way widths. (a) Collector Street requirement (1) 60' right-of-way, 24' pavement is amended to a 50' right-of-way, 32' payment. 2. Parcel Sales Chapter 23, Article 6, Division 1, Section 23-81, 82 & 83 (Hawaii County Code); Final approval before construction completed, bond required: Agreement to provide improvement and utilities: Bond. (a) Waiving of bonding and/or completion of subdivision improvements prior to final subdivision approval and offering for sale. 3. Ruddle, Chairman - Hawaii ate County Housing Agency SUBJECT: Resolution for the Hawaii County Council Preemption Request for the Low-Income Multi-Family Rental Development at Waikoloa The Office of Housing and Community Development (OHCD) has submitted to the Hawaii County Housing Agency (HCHA) a resolution to authorize the Housing Administrator to grant preemptions to code, construction, and subdivision bonding and improvement requirements for the low-income multi-family rental project (Ke Kumu) at Waikoloa. The HCHA has reviewed and approved the resolution at its meeting of October 7, 1992.
