WHEREAS, the State of Hawaii intends to construct a long term care health center facility on a parcel that is adjacent to the site of the existing Honokaa Hospital, identified as Tax Map Key No. 4-5-10:27; and WHEREAS, in order to meet the County of Hawaii's building code requirements, the State of Hawaii must consolidate the hospital site with the parcel on which the long term care health center will be constructed; and WHEREAS, in researching the ownership of Tax Map Key No. 4-5-10:27, it has been discovered that ownership is still vested in the County of Hawaii; and WHEREAS, the parcel had originally been considered to have been conveyed to the State of Hawaii in accordance with Hawaii Revised Statutes Chapter 27-21.4; and WHEREAS, Section 2-120(a)(1), Hawaii County Code, permits the sale in fee simple of real property owned by the County of Hawaii to other government or governmental agencies authorized to hold lands in fee simple; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII THAT: The Director of Finance is hereby directed, pursuant to Section 2-120, Hawaii County Code, to negotiate the sale of the County of Hawaii's fee interest in the Honokaa Hospital site described as Tax Map Key No. 4-5-10:27, to the State of Hawaii in order for the State of Hawaii to construct a long term care health center facility for the Hamakua community on that parcel adjacent to the existing Honokaa Hospital facility. BE IT FURTHER RESOLVED that the County Clerk be and is hereby directed and instructed to forward a copy of this resolution to the Director of Finance, the Mayor of the County of Hawaii, and the Department of Public Works, and that the Director of Finance be and is hereby authorized to make the necessary transfers in accordance with the terms of this resolution. This hospital site was deeded to the County in 1945 by Honokaa Sugar Company. During that period of time, hospitals were under the County's jurisdiction. The State presently maintains Honokaa Hospital. The proposed transfer of title had been requested by State Comptroller Russel Nagata through his August 20, 1991, letter to Mayor Inouye (copy attached). The State plans to build a Long Term Care Health Facility on the parcel adjacent to the hospital site. We have subdivided the original hospital site into Parcels "A", "B" and "C". Parcel "A" is the present hospital site. Parcels "B" and "C" are roadway parcels which are portions of the County-maintained Lehua Street and Plumeria Road. As such, Parcels "B" and "C" shall be retained by the County. In order to conform with Planning Department's setback requirements, the hospital site and the adjacent parcel must be consolidated. The State must first have title to the hospital site before the consolidation can occur. This resolution will enable the transfer of title to the State.
