RESOLUTION N0. 54~ 92
WHEREAS, in response to the impending foreclosure of a
$100 million plus loan to the Hamakua Sugar Company (HSC) by the
Western Farm Credit Bank, the Hamakua Regional Plan was adopted by
Hawaii County Council Resolution No. 244-90 on November 8, 1990; and
WHEREAS, the Hamakua Regional Plan represented a
cooperative planning effort by the County and the State to save about
800 plantation jobs and approximately 450 plantation housing units
associated with the operation of the financially burdened Hamakua
Sugar Company; and
WHEREAS, the Hamakua Regional Plan was meant to serve as a
planning and regulatory guide for land use decisions as well as to
provide for some certainties by which favorable market values would
be recognized in the sale of the designated parcels; and
WHEREAS, the Hawaii County Council approved a series of
State Land Use District Boundary Amendments and County Land Use
Zonings in support of the effort to market the designated lands and
to provide Hamakua Sugar Company with the financial resources by
which to meet their loan obligations and to keep the plantation
operational; and
WHEREAS, unforeseen circumstances have cast a cloud over the
land use and zoning amendments and have jeopardized the sale of the
designated lands; and
WHEREAS, unable to generate the necessary funds in order to
meet its financial obligation, Hamakua Sugar Company, in August of
1992, filed bankruptcy proceedings to seek protection and relief
under Chapter 11 of the Bankruptcy Code; and
WHEREAS, the Hawaii County Council is concerned that the
survival of Hamakua Sugar Company and the continuation of the
approximately 800 plantation jobs and 450± plantation housing units
may be in dire jeopardy; and
WHEREAS, the Hawaii County Council finds that the demise of
Hamakua Sugar Company and the loss of the plantation jobs defeats the
cooperative efforts of the State and County to expedite and grant
certain land use district boundary and zoning amendments.
NOW, THEREFORE, BE IT RESOLVED that the
County of Hawaii affirms its conditional support
Regional Plan as a planning and regulatory guide
necessary certainties to purchasers of those lane
sale in the effort to keep Hamakua Sugar Company
operational.

BE IT FURTHER RESOLVED that should the reorganization effort
in the Bankruptcy Court fails to save the Hamakua Sugar Company's
operation, the Council of the County of Hawaii reserves the right to
take the necessary actions to return the land use and zoning
designations to its original designation and shall withdraw its
support of the Hamakua Regional Plan.
BE IT FURTHER RESOLVED that the Clerk of the County of
Hawaii is directed to transmit certified copies of this resolution to
Governor John Waihee; Senator Malama Solomon; Representative Dwiqht
Takamine; Mayor Lorraine R. Inouye; Planning Commission Chairman Mike
Luce; Planning Director Norman Hayashi; Harold Masumoto, Director,
Office of State Planning; Renton Nip, Chairman, State Land Use
Commission; Yukio Kitagawa, Chairman, State Department of
Agriculture; and Olen Zirkle, Western Farm Credit Bank.

Pursuant to Section 1 (d) of Rule 4 of the Rules of Procedure of
the Council of the County of Hawaii, this written approval is
submitted in regards to Resolution No. 541, relating to the
impending foreclosure of a $100 million plus loan to Hamakua
Sugar Company (HSC) by the Western Farm Credit Bank, waiving
said referral from the Committee on planning in order that
appropriate action can be taken by the Council.
In reviewing the contents of the referral, it is deemed
advisable that such waiver be granted.
