HomeMy WebLinkAboutRES 544 Draft 01 1988-1992OFFICE INFORMAT10N ONLY December 22, 1993 Meetin6: Close file - January 12, 1994 Action: Re: Resolution 544-92 COUNTY OF HAWAII` ' STATE OF HAWAII RESOLUTION N0. 544 92 WHEREAS, the county council of Hawaii is concerned of the recent trend for processing and approving one-acre agriculture rezoning requests, many of them used primarily for residential purposes with little or no agricultural uses; and WHEREAS, the county council recognizes that there is a need to better evaluate rezoning requests on lands situated within the State land use agriculture district so that the county can better identify, conserve, and protect its important agricultural lands; and WHEREAS, the State of Hawaii Land Evaluation and Site Assessment (LESA) Commission in 1986 completed a report which provided a method to identify important agricultural lands, as well as established guidelines for reclassifying or rezoning such lands when overriding public interest exists; and WHEREAS, inasmuch as there is no comparable system of evaluation to date, the LESA system can provide the county with the needed framework for evaluating county-processed state land use reclassification and rezoning requests; NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COUNCIL OF HAWAII that all county-processed State land use agriculture to urban amendments and all county rezoning requests within the State land use agriculture district shall be evaluated using the method and guidelines established by the 1986 LESA Report, which may be modified from time to time by the county council through its policy formulation; and BE IT FURTHER RESOLVED that the county council adopt the 1986 State of Hawaii Land Evaluation and Site Assessment (LESA) Commission report as a guideline to determine its land use policies for agricultural lands; and BE IT FURTHER RESOLVED that lands deemed by the county council to be "important agricultural lands" where it can be demonstrated that there is no change in the economic or social conditions surrounding the lands, may be considered for no less than a minimum three-acre agriculture zoning; and BE IT FURTHER RESOLVED that lands not deemed by the county council to be "important agricultural lands" and that the requested rezoning or State land use boundary amendment will provide greater benefits to the general public than retaining the parcel(s)' existing zoning, may be considered for county Residential-Agriculture (RA) zoning with lots ranging between one-acre to three-acres or State land use urban and appropriate county zoning, provided that the rezoning and/or land use request is consistent with the County General Plan; and BE IT FURTHER RESOLVED that the planning director take measures to inform the public and other appropriate entities of this method of change, update its rules and applications, as may be needed, and begin processing requests using this system within 60 days of adoption of this resolution; and BE IT FURTHER RESOLVED that the clerk of the County of Hawaii transmit copies of this resolution to the mayor, the planning director and the planning commission chairman. Attached for your information is PC Report No. 91. cc: Mayor Planning Director REPORT OF THE COMMITTEE OP; Pi.r1ivNING DATE: December 21, 1993 PLACE: Councilroom TIME: 1:45 p.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Resolution No. 599-92, regarding the State of Hawaii Land Evaluation and Site Assessment (LESA) System, reports as follows: The purpose of Resolution 599-92 is to adopt the 1986 State of Hawaii LaiZd Evaluation and Site Assessment (LESA) Commission Report as a guideline to determine land use policies for agricultural lands. Resolution No. 544 92 also addressed zoning important agricultural lands to a minimum lot size of three-acres and consideration of the Residential-Agricultural (RA) zoning for lots less than three acres provided that the request is consistent with the County General Plan. Because of unanimous support from the members of the Planning Committee for Resolution 198-93, your Committee on Planning is not in accord with the intent and purpose of Resolution 544-92 and recommends that it be filed.
