AN ORDINANCE TO AMEND CHAPTER 2, ADMINISTRATION, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO THE DEPARTMENT OF HUMAN RESOURCES. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`l: SECTION 1. Purpose. The purpose of this ordinance is to amend chapter 2, Administration, Hawaii County Code 1983 (2005 Edition, as amended), to correct outdated references to the department of human resources. Ordinance No. 06-60 initiated a Hawaii County Charter amendment to, in part, change the name of the department of civil service to the department of human resources, and also the director of personnel to the director of human resources. This ordinance amends the Hawaii County Code by correcting said references so that they are in accordance with the Hawaii County Charter, as amended by the contents of Ordinance No. 06-60, which was approved by the electorate during the 2006 general election. SECTION 2. Chapter 2, article 2, section 2-7, Hawaii County Code 1983 (2005 Edition, as amended) is amended to read as follows: "Section 2-7. Organization of executive branch. Chapter 2, article 2, section 2-8, Hawaii County Code 1983 (2005 Edition, as amended) is amended to read as follows: "Section 2-8. Order of succession to office of mayor. In the event of civil, military or natural disaster, during the temporary absence or disability of the mayor, the managing director shall act as mayor. If the office of managing director is vacant, or during such periods as the managing director is unable to so act, the director of finance shall then act as mayor. If the office of director of finance is vacant, or during such periods as the director of finance is unable to so act, then the planning director, director of research and development, director of [~°~ ^~~~] human resources and director, department of liquor control, shall succeed to the office of mayor in the order specified herein." SECTION 4. Chapter 2, article 3A, section 2-10A, Hawaii County Code 1983 (2005 Edition, as amended) is amended to read as follows: "Section 2-10A. Appointment of personnel. There shall be an office of the prosecuting attorney as provided by Charter. The prosecuting attorney may appoint deputy prosecuting attorneys and necessary staff, including investigators. The investigators shall have all of the powers and privileges of a police officer for the County of Hawaii. The office of the prosecuting attorney shall adopt policies and standards for training and use of these powers consistent and in conformance with those adopted by the Hawaii County police department. All investigations relating to the discharge of a firearm by an investigator shall be conducted by the Hawaii County police department. All investigators must have the minimum qualifications for the class as established by the department of [^~°] human resources." SECTION 5. Chapter 2, article 16, section 2-94, Hawaii County Code 1983 (2005 Edition, as amended) is amended by amending subsection (d) to read as follows: "(d) Travel for training purposes shall also conform with the training policy administered by the department of [^^'°~~.~I-~ rs~] human resources." SECTION 6. Severability. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 7. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 8. This ordinance shall take effect upon approval.
