Attached are three PDF files for the review of interested Committee members. The first document is the recent letter received from DW S regarding facilities charges due for 6 units related to property use (five far the Church, one for the Pastor's residence). There is one remaining unit allocated to the property that is not presently being used. The second and third documents are correspondence between the Church and DWS dating to March 2009. The seven units of water allocated to the property are referenced and/or discussed in these documents as well. Further affinnation of the available units can be obtained from inquiry to the Department of Water Supply. For the record, it should be noted that the Church offered to pay for the water commitments for all seven units (even though units to be used was not yet determined) last October. DW S declined the Church's offer, which was made verbally to Jason Killam (961-8070, ext. 249). Alternatively, we offered to pay the facilities charges for the four units we then believed would be required for the Church property, as a good faith deposit toward the actual charges, if different. Again, our offer was refused by Mr. Killam. We have received no verbal or written request from DWS for payment of the commitment fees. However, as we explained during the hearing, we expect to pay the facilities charges within the next week, which we understand is a de facto payment of the commitment fees. We are ready to proceed with turn lane construction as soon as DPW issues the permit to work in the right-of--way. Thank you for this opportunity to provide information which we believe will explain some of the background on the water unit issue. Based on the estimated average daily usage of 1,766 gallons per day (UPD), or five (5) equivalent units of water at 400 GPD per unit, water can be made available for the church, and a 1-inch meter! should be adequate to provide the estimated demand. A reduced pressure type backflow prevention assembly must be installed within five (5) feet of the meter on private property and the installation u must be inspected and approved by the'Departmerit before. water service can be activated. Also, please be informed that the existing service is adequate for only one dwelling unit at an average daily usage of 400 gallons. Inasmuch as this application is proposing an additional dwelling (Pastor's house), the installation of a separate $/8-inch meter is required. - Therefore, prior to granting water service, the prevailing facilities charge, which.is subject to change, of $33,000.00 must be paid. The facilities charge is due upon completion of the necessary water system improvements Please be reminded that after the completion of water system improvement and payment of applicable fees, there will be no water available for a proposed school. Extensive improvements and additions, which may include, but not limited to source, storage, booster pumps, transmission, and distribution facilities, would be required. They were forwarded to us on March 9, 2009. This is the first time we have seen or known about the memo dated August 21, 2008. We appreciate the opportunity to now be directly included in communicatons from DWS. With regard to our currently pending applications before the Planning Commission, we understand that Dan and Jan Bolton (owners of a portion of the'property on which our church is situated) visited your Department's offices on September 2, 2008 and met with Kurt Inaba and Sherry Komata. We believe they resolved the issues mentioned in your memo dated August 21, 2008, including the Department's understanding of the reasons=forthe withdrawal of the previous subdivision map. That withdrawal was required by Bruce McClure, Director of Public Works, in a meeting that took place on May I, 2003. This was understood to be aquid-pro-quo t'or DPW agreeing to pay f'or a portion of the HELCU & Hawaiian Tel utility relocations required on Palani Road. The promised County contribution of $75,000 was paid to HELCO in November last year. Based on a copy of a fax memo sent by Jason Killam of DWS to Dan Bolton on October 2, 2008, wherein the 7 units of water allocated are specifically referenced, it seems apparent that the units have been restored to the property on which our Church is located. We are very grateful to D W S for that action. Part of the problem we have experienced during the past few ycazs is that we have been outside the "loop" oi'DWS communications on matters related to the water waits for ow' property and payments that may have been due. While we cannot change the past, we aze committed to proactively staying abreast of matters requiring our resolution and/or action. W e have asked that we be copied on any communications that occur between DW S and any other entities, so that we can stay informed about matters that arise relating to our project. Jason does not believe that can happen before our engineer (Leo Fleming) provides water demand calculations, but we are nonetheless prepazed to do it as a sign of good faith. We are likewise ready, willing and able to pay the required facilities chazges as soon as requested by DWS. This has always been our desire and intent. Untbrtunately, being outside the line of direct communication has caused much confusion and misunderstanding for us all. Our goal is to put that behind. us and move forward with as much speed as can be applied, to bring this project to completion. Our primary concern on the. construction plans were the proper anchoring and support of the nhove ground high pressure temporary bypass line, as this has the potential to cause property damage and injury to passerby. Secondly, the issue of water commitments is not resolved. In your letter dated October 10, 2008, there is mention of 10 water eotnmitments. Huwever, our May 19, 1997, memo to the Planning Department indicates six (6) additional water commitments were made available from a Change of Zone application. Those water mots combined with the one (l) water unit from the existing 5/8-inch meter servicing the parcel, would result in a maximum of seven (7) units available for your project. Furthennoro, the submitud water usage hisrory, although appreciated, does not satisfy the requirement of the engineer certified water demand calculations as requested in our May 19, 1997, and October 2, 2008, loners. Please have a licensed engineer submit water demand calculations, water unit allocations for each lot and assignmont of any left. over units. Please be advised, if water availability in this area should change then any unallocated units may be lost. Finally, the letter also mentions the possibility of a furore school, please he advised that based on current availability, dtere is no sufficient water units for n school, nor the 5/8-incb meter would be .ufticiently-sized. These matters will need to be addressed prior to water service being granted to the proposed school.
