Resolution
RELATING TO THE COTdSTP.UCTIOTd OF A DRAINAGE CHANNEL IN HOLUALOA,
NORTH KONA, HAWAII, AS PP.OPOSED EY PETITION DATED NOVEMBER 24, 1982,
AND FILED WITH THE COUTdTY CLERK ON NOVEMBER 29, 1982.
GIHEREAS, by Petition dated IQovember 24, 1982 and filed in the
Office of the County Clerk on Tdovember 29, 1982 (Comm. No. 1031),
the owners of the subject real property petitioned this Council
for construction of special improvements consisting of a drainage
clxannel within certain land situated at Holualoa, North Kona, Hacaaii,
the cost of which will be borne by the property owners, all pursuant
to the provisions of Section 3.01, Article 3, Chapter 6, Hawaii
County Code; and
WHEREAS, the Petitioners allege that they are the owners of
not less than 60 percent of the assessable area within the proposed
Improvement District; and
WHEREAS, the Petition contains the necessary preliminary data
concerning the special improvements, cost estimates of the improve-
ments, and an estimate of the share of the cost of the improvements
to be assessed against the property within the Improvement District;
and
WHEREAS, the Petition has been fully considered by the Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OP
HAWAII that tine Chief Engineer of the Department of Public Works,
County of Hawaii, be and is hereby directed to investigate and to
report to the Council preliminary data regarding the special improve-
ments to land in Holualoa, District of North Kona, County and State
of Hawaii, described in the owners' Petition, including those items
required by Section 1, Article 3, Chapter 16, Hawaii County Code.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
be directed to furnish the Petitioners and the Chief Engineer with
a copy of this resolution.
