RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE
WITH THE STATE OF HAWAII FOR THE ADVANCEMENT OF THE PLANNING
AND DESIGN COSTS OF WASTEWATER TREATMENT WORKS PROJECTS.
WHEREAS, Section 342-34, Hawaii Revised Statutes,
authorizes the State of Hawaii to advance funds to the
County of Hawaii in financing the federal share of the
planning and design costs of wastewater treatment works
projects, which advance is to be reimbursed to the State of
Hawaii from the federal funds received by the County of
Hawaii for the projects or within four years after the
advance is made, whichever occurs first; and
WHEREAS, the County of Hawaii intends to construct the
wastewater .treatment works projects described in
Exhibit "A," attached hereto, which projects will be
financed by means of federal funds; and
WHEREAS, the County of Hawaii is desirous of beginning
the planning and design phase of the subject wastewater
treatment works projects prior to the County's receipt of
the federal funds for these projects, which costs are listed
in Exhibit "A," attached hereto; and
WHEREAS, the County of Hawaii is desirous of obtaining
an advancement of the planning and design costs for the
subject wastewater treatment works projects from the State
of Hawaii; and
WHEREAS, the advancement of funds by the State of
Hawaii for the subject wastewater treatment works projects
may require the payment of funds by the County of Hawaii
beyond the end of the fiscal year in which the advancement
is made to the County of Hawaii requiring the approval of
such action by resolution of the Council of the County of
Hawaii; and
WHEREAS, the Finance Director may negotiate such
advancements from the State of Hawaii, pursuant to
Section 5-3.3(c) of the Hawaii County Charter, when
authorized by the Council of the County of Hawaii,
NOW, THEREFORE, BE IT RESOLVED BY THE
COUNTY OF HAWAII that the Finance Director
negotiate with the State of Hawaii for the
funds for the planning and design costs of
treatment works projects described in and
listed in Exhibit "A," attached hereto;

BE IT FURTHER RESOLVED that any funds advanced by the
State of Hawaii to the County of Hawaii for any of the
wastewater treatment works projects described in
Exhibit "A," attached hereto, are to be reimbursed to the
State of Hawaii at such time as the County of Hawaii
receives the federal funds for the wastewater treatment
works projects or within four years from the date of the
advancement of the funds to the County of Hawaii by the
State of Hawaii, whichever occurs first.
BE IT FURTHER RESOLVED that the Clerk of the County of
Hawaii remit a copy of this resolution to Mr. Stanley A.
Nakamae, Finance Director, and Mr. Edward Harada, Chief
Engineer.
