(AMENDED)
WHEREAS, on September 9, 1982, the County Clerk of the
County of Hawaii submitted his certification attesting that
the Charter Amendment Petition presented by the Hawaii County
Taxpayers Association on August 23, 1982, meets the mandated
Charter numeric requirement; and
WHEREAS, the amendment in essence proposes to eliminate
in its entirety Section 11-2 of the Hawaii County Charter
which states "Limitations to Powers. The initiative power
and the referendum power shall not extend to: any part or all
of the operating budget or capital budget; any financial
matter relating to public works; any ordinance making or
repealing any appropriation of money or fixing the salaries
of county employees or officers; any ordinance authorizing
or repealing the levy of taxes; any emergency legislation";
and
WHEREAS, Section 15-2 of the Hawaii County Charter requires
the Council to provide by resolution that the proposed amendment
be submitted to the electors of the County at the next general
election; and
WHEREAS, said resolution is not to be construed as either
approval or disapproval by the Council of the proposed amendment.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that in conformance to Section 15-2 of the
Hawaii County Charter that it instructs the Clerk of the County
of Hawaii to submit to the electors of the County and include
the proposed charter amendment on the November 2, 1982 General
Election Ballot.

BE IT FURTHER RESOLVED that said amendment in its
entirety be published in a daily newspaper of general
circulation in the county at least forty-five days prior to
November 2, 1982.
BE IT FURTHER RESOLVED that true copies of this resolution
be sent to the Clerk of the County of Hawaii, the Office of
the Lieutenant Governor and the Hawaii County Taxpayers
Association.
