County of Hawaii - State of Hawaii
Resolution
WHEREAS, the Hawaiian Ocean View Estates on May 4th, 1965
granted to the County of Hawaii fifteen lots containing 76.00 acres
with the condition that the land be used for elementary,
intermediate, high schools and for a park or playground site; and
WHEREAS, the County of Hawaii in the foreseeable future has no
plans to develop the land donated to the County, for park or
playground purposes; and
WHEREAS, the Hawaiian Ocean View Estates Community Association
(HOVECA) requested that the County grant two one-acre parcels
adjoining their Community Center to HOVECA, enabling the association
to develop a park for public and community use, without any cost to
the County; and
WHEREAS, pursuant to Chapter 2, Article 19, Hawaii County Code
(Ordinance Nos. 69, 364, and 819) the County Council may by
resolution, approved by a majority of its members, direct the
Finance Director to negotiate the disposition of real property by
"Leasing it to non-profit organizations organized for other than
profit-making purposes and which is exempted from the federal income
tax by the Internal Revenue Service"; and
WHEREAS, HOVECA has filed a copy of the document with the County
Clerk's Office attesting to the tax exempt status by the Internal
Revenue Service".
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it authorize and direct the Director of Finance of the
County of Hawaii to negotiate a long term lease with Hawaiian Ocean
View Estates Community Association, pursuant to Chapter 2, Article
9, Hawaii County Code (Ordinance Nos. 69, 364, and 819), with regard
to the two-acre parcel adjoining the HOVECA Community Center
(Tax Map Key:9-2-09-052 Block 29, Lots 14 & 15).
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
remit a copy of this resolution to the County Director of Finance
and to the Hawaiian Ocean View Estates Community Association.
