AN ORDINANCE AMENDING ARTICLE 1 OF CHAPTER 2 OF THE HAWAII COUNTY CODE 1983 RELATING TO ADMINISTRATION CONCERNING THE BONDS FOR OFFICIALS. BE IT ORDAINED BY THE COUNCIL OF' THE COUNTY OP HAWAII: SECTION 1. ose. Hawaii County Charter 1991, §13-6 states: The director of finance and such other cowrty officers or employees as the council may require shall furnish bonds iri the amount and with the surety prescribed by the council by ordinance. The premiums on such bonds shall be paid by the county. Hawaii County Code §2-2 presently sets out a list of county officers and the amount of the bonds required for them. The amounts of these bonds have not been increased in several years and are out of date. The City and County of Honolulu, for example requires bonds of $225,000 for its finance director and its treasurer. Maui County requires . $50,000 bonds fcr all depa+-t,rent heads wrd elected officials. In this bill, the Council would authorize the Director of Finance t:, set bond amounts at reasonable levels, and take into consideration the amounts o1'mc;+:ey the various officers and employees are responsible for. SECTION 2. Chapter 2. article 1, section 2-2 of the Hawaii County Code 1983 (1995 edition) is amended to read as folk+ws: Section 2-2. Bonds of officials required; amount; filing; payment of premiums. (a) [In accordance with the provisions of section 13-6 of the Charter bonds in the following amounts shall be furnished by the following officers and employees: Officers and Employees Bonds Mayor $25,000 Councilman(each) 10,000 Prosecuting attorney 20,000 Director of finance 25,000 Corporation counsel 20,000 Deputy director of finance 20,000 Controller 20,000 Treasurer 20,000 Purchasing agent 10,000 Cashier 10,000 County clerk ............................................15,000] All officers concerned with the receipt, collection, custody or disbursement of public funds shall be covered by a fidelity bond, the amount of which shall be determined by the Director of Finance. The Director of Finance shall determine which other officers of the County of Hawaii shall be covered by bonds and shall fix the amount of such bonds. The Director of Finance shall procure such bonds from among companies licensed within the state. All bonds shall be in favor of. and the premiums thereon paid for by. the County of Hawaii. (b) Officers and employees of the legislative branch shall file their bonds with the clerk. Officers and employees of the executive branch shall file their bonds with the director of finance. [(c) the premium on the bonds shall be paid by the County.] SECTION 3. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. -2- SECTION 4. If any provision if this ordinance, or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
