Resolution
WHEREAS, Section 10-11 of the County Charter requires that
any contract, lease or other obligation requiring the payments of
funds from the appropriations of a later fiscal year or of more
than one fiscal year shall be made or approved by resolution;
WHEREAS, by Communication No. 1209/Finance Committee Report
No. 328 the Council approved the purchase agreement and lease
documents relating to the Keaau Community Center; and
WHEREAS, the lease agreement with W. H. Shipman, Ltd. is for
a period of twenty years and requires payment of rent in the sum
of $1.00 per year for the first 5 years, $1,000 per month for the
second five-year term, $1,100 per month for the third five-year
term, and $1,210 per month for the fourth five-year term;
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it approves the purchase agreement and leasing
documents. for the Keaau Community Center and that it shall provide
sufficient funds to meet the obligation of the County in future
years. -
