WHEREAS, the Planning Commission, as defined by the Hawaii
County Charter, consists of nine members representative of the
community, appointed by the Mayor and confirmed by the Council; and
WHEREAS, the Planning Commission reviews applications for
general plan amendments, amendments to the zoning and subdivision
codes, street names, and transmits recommendations to the Council;
and
WHEREAS, the Planning Commission is responsible for final
decision-making regarding applications for special permits, use
permits, planned development permits, coastal zone management
permits, variance appeals, and others; and
WHEREAS, decision-making efforts, requiring five votes for the
approval of applications, are gravely debilitated as a result of the
Commission's incomplete membership due to the vacancy of three posts
since December, 1982; and
WHEREAS, the Mayor has had six months to fill three vacancies on
the Commission; and
WHEREAS, the Mayor has refused to fill said vacancies; and
WHEREAS, the Council views the functioning of a six-member
Planning Commission as unacceptable and not in the best interest of
the County of Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it requests the Planning Director to transmit directly
to the Council all applications for general plan amendments,
rezoning, land use boundary amendments, special permits, use
permits, planned developments, coastal zone management permits, and
other related matters, eliminating Planning Commission involvement,
until such time when names of the-three additional planning
commissioners are submitted by the Mayor.

BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is
hereby instructed to transmit copies of this Resolution to
Mayor Herbert T. Matayoshi, Planning Director Sidney Fuke, and
Planning Commission Chairman Clyde Imada.
