OFFICE OF THE CORPORATION COUNSEL. CHILD SUPPORT DIVISION 1. Add one new position of Deputy Corporation Counsel LG-1 (1/2 time). BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the departments of Corporation Counsel, Finance and Civil Service for their information. The addition of a half-time deputy corporation counsel position to the staff of the Family Support Division is essential if the Division is to effectively and competently carry out its contractual obligation with the State. As of this date, the Division is handling approximately 4,000 active cases with 75 new cases being added each month. The workload is too heavy for the present staff of two deputies. An ever-increasing number of these cases are being set for court action, when in the past many were settled out of court. The extra time required to prepare cases for court results in a smaller total caseload that can be handled by any one deputy. With the recent placement of a circuit court judge in Kona, the Division now has hearings scheduled in courts on both sides of the island, sometimes at the same time. The Division has very little control over the scheduling of hearings. Should one of the two deputies be sick or on vacation, the other deputy has to cover all hearings. The addition of a part-time deputy will reduce the present problem of shceduling of hearings. In sum, the large and growing caseload, the tendency to litigate rather than settle, and the fact that several hearings may be set at the same time require the addition of this position. There do not appear to be any alternatives to the problem other than the addition of personnel. The Division has no control over the amount of work coming into the office. Preparation of cases has already been streamlined with the use of form pleadings and other measures. The change will not affect positions in the main office or in other. departments.
