RESOLUTION ABANDONING, VACATING, CLOSING, AND DISCONTINUING THE
RIGHT-OF-WAY KNOWN AS WAIMALINO LANE, TMK: 2;"'6-7:5, AND
AUTHORIZING THE COUNTY OF HAWAII TO SELL THE RIGHT-OF-WAY KNOWN
AS WAIMALINO LANE, TMK: 2-6-7:5, AS A REMNANT, PURSUANT TO
HAWAII COUNTY CODE 52-118.
WHEREAS, the County of Hawaii owns the subject right-of-way
referred to as Waimalino Lane, located off Amauulu Road,
TMK: 2-6-7:5, in South Hilo, County and State of Hawaii, and
recorded in the Bureau of Conveyances of the State of Hawaii in
Liber 345, pp. 55-56; and
WHEREAS, the abutting property surrounding the subject
right-of-way on these sides is owned by Riverview Development
Partners, while the -fourth side's abutting property is a public
road owned by the County of Hawaii; and
WHEREAS, Riverview Development Partners intends to develop
the abutting property surrounding the subject right-of-way as
residential property and desires to acquire the subject
right-of-way for incorporation i~to the project; and
WHEREAS, Riverview Development Partners desires to acquire
the SUbject right-of-way through the process established by Hawaii
County Code 52-118 for disposal of County real property without
auction as a remnant; and

WHEREAS, the County of Hawaii, through its Department of
Public Works, finds that the subject right-of-way is v~c~ted,.
closed, abandoned or otherwise discontinued, and is economically'
and physically unsuitable or undesirable for development or
utilization as a separate unit by reason of size, location and
shape;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
.
OF HAWAII that the subject right-of-way, as delineated in red on
the map attached hereto and marked Exhibit -A,- is declared to be
a remnant because it is a vacated, closed, abandoned and otherwise
discontinued right-of-way which is physically and economically
unsuitable or undesirable for development or utilization by reason
of location, size and shape, pursuant to Hawaii County Code 52-110.
BE IT FURTHER RESOLVED that, inasmuch as the subject
right-of-way is a remnant, the County of Hawaii is hereby
authorized to sell the sUbject right-of-way without recourse to
public auction in the manner set forth in Hawaii County

Code 52-llS, to Riverview Development Partners, the abutting owner.
BE IT FURTHER RESOLVED that said sale of ,the sUbject
right-of-way shall include the following conditions:
1. That there shall .be reserved a utility easement for the
entire length of the subject right-of-way for the benefit of The
Gas Company, for the purpose of maintaining utility service; and
2. That Riverview Development Partners, the buyer of the
subject right-of-way, be required to assume the entire cost of

instructed to transmit copies of this resolution to the Honorable

and Mr. William Takaba, Director of Finance.

The Department of Water Supply has no objections to abandoning the existing
waterline within the road right-of-way, situated within the parcel identified as
Tax Map Key 2-6-07:5, provided the following are complied with:
1. The entire cost required to cut and plug the existing waterline will be
borne by whomever purchases the right-of-way.
2. The purchaser will also be responsible for all costs required if existing
water services must be relocated. We are unable to determine if any services
are involved until the boundary of the parcel is located on the ground.
3. . No work will be permitted on the existing waterline without the prior
approval of our Department.

Proposed Sale of Right-of-Way

In response to your August 19, 1991 letter on the subject, we do not have
any objections to the sale of the right-of-way provided that there are no
existing electrical pole lines or anchors in the 14 foot right-of-way.
Our records show that the southern most pole line extension tapped from
Waimalino line is across TMK 2-6-7:10 which provides electrical service to
TMK 2-6-7:23. See enclosed easement drawing for liber 9494 page 211 for
TMK 2-6-7:10.

As noted in your letter, dated October 3, 1991, regarding the
proposed sale of a portion of Waimalino Lane; the following
comments are submitted: Gasco, Inc proposes that a utility
easement for the entire length of Waimalino Lane be granted
as a conditon of the sale of the property. This will allow
our company to maintain utility gas service to customers,
should there be future development in that area.

Amauulu Development
A meeting was held on May 30, 1991, 9:00 a.m., at the office of the
County of Hawaii, Chief Engineer regarding the acquisition of the
County Easement on the project site. The following is a brief
summary of that meeting.
1.0 Those present included:

2.0 The purpose for this meeting was to:
2.1 Determine whether the County administration would be in
favor of selling this easement to a potential Buyer.
2.2 Determine the procedures to follow in proceeding with the
acquisition.
2.3 Determine the entities involved in the decision making
process.
2.4 Determine an approximate timetable for this process to be
completed.
3.0 Records indicate the County owns the property in fee simple.
The property is a right-of-way, not an easement.
4.0 Sale of the property will require County Council approval.

5.0 Public Works, Finance and Corporation Counsel seemed to agree
that the property can be sold. However, they were not sure
whether they could negotiate the sale as the County Code has
language stating that the sale should be based on the highest
bidder. Corporation Counsel will recommend negotiated sale
because of the uniqueness of the property.
6.0 Procedures:
6.1 Corporation Counsel will prepare a resolution to the
Council, recommending sale of the property, under Section
2-114 of the County Code. They will include a map of the
property and justification for recommending the sale.
Public Works will select appraisers and Buyer shall pay
for the appraisal. They will also prepare the necessary
maps and lot descriptions.
6.2 After the Council gives approval for the sale, the
Finance Director will publish notice of the pending sale
for three consecutive weeks, as required by the County
Code. The notice is intended to give the public an
opportunity to submit comments.
6.3 Assuming the sale can be negotiated, the Buyer would be
negotiating with the Finance Director.
6.4 When the sale is finalized, the deed to the property will
be turned over to the Buyer.
7.0 Once the sale is finalized, the Buyer will need to consolidate
the property so it will be under the same zoning as the rest
of his property.
8.0 The anticipated timetable will be as follows:
8.1 Corporation Counsel will prepare the resolution for
submission to the Council on June 24, 1991. This date is
the deadline, by which, items for Council action must be
submitted for the appropriate Council committee to review
and recommend a decision to the full Council.
8.2 Council will decide on the sale during their July 3, 1991
general meeting. At this point, the decision can be to
proceed with the sale, deny the sale or defer to a later
meeting.
8.3 Assuming the Council authorizes the sale, the notice and
negotiating process begins.

9.0 Public Works recommended that the neighborhood community be
informed about the pending development. Its a good idea to
gain the local community's support because the Council will
probably ask the Buyer about the community's reaction
regarding the project.
10.0 Public Works will check whether the Department of Water Supply
will abandon the existing waterline, presently in the
easement. They will also check with Helco.
11.0 The Buyer or his representatives should be present during the
full-council hearing to answer questions.
