AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 7, DIVISION 8, OF THE HAWAII
COUNTY CODE 1983 (2005 EDITION, AS AMENDED), VEHICLES AND TRAFFIC,
RELATING TO MOPEDS
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this measure is to clarify the registration of
mopeds and current Hawaii Revised Statutes requiring certificates of inspection for mopeds.
SECTION 2. Chapter 24, article 7, division 8, section 24-186.1, Hawaii County
Code 1983 (2005 edition, as amended), is amended to read as follows:
"Section 24-1861. ( .Moped rules.
~ No person shall:
(1) Operate a moped on any highway or street in the County unless that person is
properly wearing protective eyewear.
(2) Offer for lease or rent a moped without providing to the operator protective
eyewear.
Every moped shall be certified pursuant to Hawaii Revised Statutes section 286-26
certificates of inspection prior to the issuance of a registration by the director of finance
and prior to the transfer of anv registration• provided that this requirement shall not apps
to anv subsequent transfer of registration in a moped that carries a current certificate of
inspection."
SECTION 3. Material Co be repealed is bracketed and stricken. New material is
widerscored. [n printing this ordinance, the brackets, bracketed and stricken material and
underscoring need not be included.
SECTION 4. If any provision of this ordinance, or the application thereof to any person
or circumstance is held invalid, such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid provision or application, and to this
end, the provisions of this ordinance are declared to be severable.
SECTION 5. "this ordinance shall take effect upon its approval.
