AN ORDINANCE AMENDING CHAPTERS 19 AND 21 OF THE HAW Ail COUNTY CODE
RELATING TO REAL PROPERTY TAX AND SEWERS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The Council finds that Chapter 21, Section 5, of the Hawaii
County Code, requiring property owners to hook up to available public sewer laterals, places a
substantial financial burden on those property owners. The Council further fmds that the reason
behind the mandatory hook up to the public sewer system is for the overall benefit of the
community, specifically the protection of water and environmental resources. Requiring a small
percentage of the public to bear the cost for a community wide benefit is not equitable. This Bill
attempts to provide some relief to those property owners affected by Chapter 21, Section 5, of
the Code.
SECTION 2. Chapter 19 of the Hawaii County Code is hereby amended by adding a
new article to read as follows:
"Article 13. Tax Credits.
Section 19-( ) Tax credit for mandatory sewer hook up.
A property owner who is required by the provisions of Chapter 21. Section 5. to
hook up to the public sewer system shall be entitled to a real property tax credit. The tax
credit shall be applied to the property owner's real property tax bill. in equal increments,
for no more than ten consecutive ~
The amount of the overall tax credit shall be the lesser of the cost incurred by the
property owner in hooking up to the sewer system or ten thousand dollars. Furthermore.
the annual tax credit amount shall not exceed one thousand dollars.
The property owner shall submit to the finance department all materials requested
by the Finance Director to determine the total cost incurred in hooking up to the public
sewer sytem. Documentation to verify the total cost of the mandatory sewer hook-up. as
required by the Finance Director. shall be submitted to the finance department by ( )."
SECTION 3. Chapter 21, Section 5, of the Hawaii County Code is hereby amended by
adding a new sub-section (d) to read as follows:
"(d) A property owner who is required by the provisions of this section to connect to the
public sewer sytem shall be entitled to a real property tax credit pursuant to Ch~ter 19.
Article B."
SECTION 4. Material to be added is underscored. In printing this ordinance, the
underscoring need not be included.
SECTION 5. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the provision of the application, and to this
end, the provisions of this ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon approval.
