RESOLUTION NO. ~~'7 0~
A RESOLUTION REVERTING THE COUNCIL VICE CHAIR, COMMITTEE CHAIRS,
AND COMMITTEE VICE CHAIRS BACK TO THEIR ASSIGNMENTS BEFORE THE
ADOPTION OF RESOLUTION NOS. 200-09 AND 201-09
WHEREAS, Resolution No. 200-09 was adopted on June 16, 2009, which replaced Pete
Hoffmann as Council Vice Chair with Emily I. Naeole; and
WHEREAS, Resolution No. 201-09 was also adopted on June 16, 2009, which changed
the Committee Chair and Vice Chair assignments as follows:

WHEREAS, on July 10, 2009, West Hawaii Today filed a lawsuit against the Hawaii
County Council asserting that the Council violated the Sunshine Law; and
WHEREAS, because of the alleged Sunshine Law violation, West Hawaii Today
further claims that the reorganization and all post-reorganization actions taken by the Council are
invalid; and
WHEREAS, Corporation Counsel made a recommendation on July 22, 2009, that the
Council, in an abundance of caution, should render null and void Resolution Nos. 200-09 and
201-09 and return the Council organization back to its previous state; and
WHEREAS, the Council wishes to move forward with its business while the lawsuit is
pending in order to continue its service to the public; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Hawaii County Council reverts the Counci! Vice Chair, Committee Chairs, and Committee Vice
Chairs back to their previous assignments before the adoption of Resolution Nos. 200-09 and
201-09 on June 16, 2009.
BE IT FURTHER RESOLVED that Resolution Nos. 200-09 and 201-09 are hereby
rescinded.
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to Corporation Counsel and Robert D.S. Kim, Attorney for West Hawaii Today.
