SUBJECT: A Resolution Reverting the Council Vice Chair, Committee Chairs, and
Committee Vice Chairs Back to Their Assignments Before the Adoption of
Resolution Nos. 200-09 and 201-09
Resolution Nos. 200-09 and 201-09 were adopted on June 16, 2009, which changed the
Council Vice Chair and Committee ChairNice Chair assignments, respectively.
After the adoption of these resolutions, a lawsuit was filed against the Hawaii County Council
alleging that the Council violated the Sunshine Law. The suit further alleges that the
reorganization and all post-reorganization actions taken by the Council are invalid.
Attached is a proposed resolution to revert the Council'Vice Chair, Committee Chairs, and
Committee Vice Chairs back to their assignments before the adoption of Resolution Nos. 200-09
and 201-09. This move will allow the Council to move forward with its business while the
lawsuit is pending and continue its service to the public.
