AN ORDINANCE AMENDING CHAPTER 24, OF THE HAWAII COUNTY CODE 1983
(1995 EDITION), RELATING TO VEHICLES AND TRAFFIC.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI'L•
SECTION 1. Purpose. There have been increased complaints from the public
concerning vehicles utilizing larger than stock or oversized tires. The focus of the complaints
has been damage caused by rocks or other hard projectiles being kicked up by these types of
vehicles which are damaging car windshields and creating a hazardous condition.
SECTION 2. Chapter 24, article 6, division 4, section 24-104, of the Hawaii County
Code 1983 (1995 edition), is amended to read as follows:
Section 24-104. Windshields, fenders, and bumpers required; exception.
(a) Every motor vehicle upon a highway, excepting a motorcycle or motor scooter,
shall be equipped with a windshield and front and rear bumpers.
(b) Every motor vehicle upon a highway shall be equipped with fenders for all
wheels[.] which shall cover the protrusion of the wheels outside of the outer edge
of the fender well to prevent or minimize kickin~p of rocks or other hard
projectiles from these wheels.
(c) Where the type of vehicle and the usage of the vehicle make the foregoing
equipment impractical, such equipment may be eliminated upon approval of the
chief of police.
SECTION 3. Material to be repealed is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material and underscoring need not be included.
SECTION 4. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid provision or application, and to
this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
