The bill was never placed on an agenda thereafter.) Re: Bill 274, Comm 802 (2000) COUNTY OF HAWAII STATE OF HAWAII BILL NO. 274 ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 24, OF THE HAWAII COUNTY CODE 1983 (1995 EDITION), RELATING TO VEHICLES AND TRAFFIC. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 24, article 10, division 8, section 24-293, schedule 41 (Use of certain streets by certain vehicles restricted), subsection (a) Hamakua, of the Hawaii County Code 1983 (1995 edition), is amended to read as follows: (a) Hamakua (1) [Vehicle with a capacity ofthree-quarters of a ton or over: (A) Pakalana Street between Lehua Street and Kukui Street in a northerly direction except that any vehicle equipped with safety brakes consisting of an automatic spring that will actuate the brakes when the air pressure drops below sixty pounds per square inch maybe operated during the hours when Honokaa High and Elementary School is not in session. All vehicles equipped with safety brakes shall first be checked and approved by the chief engineer of the department of public works before they are operated on such street. The approval of the chief engineer shall be valid for a period of three months. (B) Waipio Valley Road in Hamakua from the top of the lookout to the bottom of the valley, restricted to four-wheel drive vehicles only. (C) Makai-bound traffic shall yield to mauka-bound traffic on the access road into Waipio Valley.] Pakalana Street, from Lehua Street to Mamane Street, makai bound only: Any i vehicle with three or more tons gross vehicle wei hg t shall not travel in the makai-bound direction. This restriction shall not be applicable to emergency vehicles and during emergencies declared by the mayor. Waipio Valley Access Road Vehicle capacity shall be less than three-quarters of a ton. Vehicle shall be engaged in four-wheel drive mode. Makai-bound vehicle shall yield to mauka-bound vehicle. These restrictions shall not be applicable to emergency vehicles and during emergencies declared by the mayor. SECTION 2. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 3. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 4. This ordinance shall take effect upon its approval.
