The financial hardships it would bring to us and, the uncertainty of the economy prohibits us from continuing our attempt to rezone. We feel we have complied with Condition G (1) as an existing approved driveway under the old IIawaii County Code, Chapter 22 and fact it should remokn "as is." tt also appears that we meet current Hawaii County Code, Chapter 22, Division 3, Section 22,4,8.(b) which states All driveway approaches shall be constructed in accordance with this Chapter EXCEPT for those County streets that do not have curbs and sidewalks and are fully paved from the lateral line of the roadway up to the property line. Our property does comply with this exception. We feel we have also complied with Condition G (2), G (3) anti r T (5) regarding sight distance as explained in current Hawaii County Cock, Ardclc 2, Section 22-2.2.(a) which states To preserve adequate vehicular sight distance at intersections formed by two or more County streets, no object with a height between three feet and eight feet above the nearest surface of the County street shall be allowed within the area defined by the chord of un arc ha%,itg a radius of thirty feet from the intersection of property lines or their extensions that fort the intersection. We continue to oppose any dedication of our property, Condition G (4) as did the Planting Commission in our February 19, 2009 hearing when they deleted this condition from its recommendation. If after reviewing our comments, the Council Members agree that Condition G must remain as part of Bill 54, we are respectfully requesting that Bill 54 is killed.
