Resolution
WHEREAS, the County has followed the practice of equal treatment
to all contractors with regard to their securing of bonds to insure
satisfactory performance and completion of contracted work or the
supply of goods and services; and
WHEREAS, this practice has caused unnecessary expense to the
contractor and the County for the purchase of these performance
bonds which are equal to fifty percent of the contracted bid amount;
and
WHEREAS, this bond value is justified in cases where the
contracted work is for the construction of a structure or building
but less significant in those cases where the contract is to supply
the County with goods and services; and
WHEREAS, this expense may be reduced by the adoption of a policy
that would lower bond values in such cases to one-twelfth the annual
contract amount with relatively little risk to the County; and
WHEREAS, adoption of this policy is in consonance with
H.R.S. 103-34 which allows the County to set bond amounts in
price-term, open-end and requirements contracts of this nature.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it encourages the County Administration to implement a
policy of reducing performance bond values to one-twelfth the bid
amount on future price-term, open-end and requirements contracts.
BE IT FURTHER RESOLVED that the Clerk is hereby directed to
transmit a copy of this Resolution to the Honorable Mayor Herbert T.
Matayoshi and Finance Director Stanley Nakamae.
