HomeMy WebLinkAboutRES 767 Draft 01 1980-1984,, t County of Hawaii-State of Hawaii Resolution 110. ~6~ ~a WHEREAS, Chapter 2, Article 19, Section 2-114, Hawaii County Code, as amended, provides that the County Council may direct the Finance Director to negotiate the disposition of real property by lease to non-profit organizations at such terms and conditions as deemed proper; and WHEREAS, the Councy Council has expressed the need for a Shelter for Abused Spouses in this County; and WHEREAS, the County has acquired property located at 2020 Kinoole Street, Hilo, Hawaii 96720, to house a Shelter for Abused Spouses; and WHEREAS, it is the County Council's intent that a lease of this property be negotiated with a qualified non-profit organization, as defined in Chapter 2, Article 25, Section 2-136, which shall operate the Shelter for Abused Spouses, and which meets the following criteria: 1. That it has at least one year's experience in operating a shelter, or other substantially equivalent experience; and 2. That it has proven management experience, particularly with the procurement and development of resources which are essential to the operation of a shelter; and 3. That it has demonstrated an ability to secure funding from sources, other than the County; and 4. That it is chartered to conduct the activity, and has a governing board which represents the community, whose members serve without compensation and have no conflict of interest between their regular occupations and the services provided by the organization; and .: O 5. That it has bylaws or policies which describe the manner in which business is conducted, including management, audit, and fiscal policies and procedures, policies on nepotism; and 6. That it has proven that it is complying with licensing or accreditation in accordance with applicable requirements of federal, state and county laws; and 7. That it can show evidence that the organization is exempt from federal income taxes; and 8. That it can show that it has, and will have, throughout the duration of the lease, qualified personnel to operate the facility; and 9. That it will hold harmless and indemnify the County of Hawaii from all claims and losses resulting from the use and occupancy of the facility, and has and will maintain, in full force and effect, throughout the term of the lease, an insurance policy: a. covering the building against losses from fire and windstorm, and b. providing comprehensive general liability coverage in the aggregate limit of $300,000.00, naming the County of Hawaii as additional insured; and 10. That it shall keep the premises in good repair and shall provide additional improvements to be specified by the County. -2- 4 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Finance Director is hereby directed to select an organization meeting the criteria outlined above, and to negotiate a lease, with terms to include a maximum duration of five years, at set rental of $1.00 per year. BE IT FURTHER RESOLVED that the Deputy Managing Director and the Housing Administrator work closely with the Finance Director in selecting the organization and negotiating a lease agreement; and BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the Office of the Mayor, the Department of Finance, and the Office of Housing and Community Development.
