WHEREAS, the Hawaii County Council is charged with the primary responsibilities of legislation and public policy formulation; and WHEREAS, the exercise of these powers is possible under the Hawaii State Constitution and the laws of the State of Hawaii; and WHEREAS, through the course of performing its duties, the Council may find it desirable to attempt a change to the laws of the State which reflect the interest of Hawaii; and WHEREAS, the Council's Legislative Procedures are meant to provide an implemental framework to effectuate those legislative considerations and reform. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the attached HAWAII COUNTY COUNCIL'S LEGISLATIVE PROCEDURES is hereby adopted to implement the legislative duties of the Council. The Planning Committee will solicit ideas for legislative proposals for the upcoming session. Proposals must be submitted in writing. 8. Proposed bills/concepts from Councilmembers and the Mayor shall be forwarded to the Planning Committee for preliminary discussion. II. Legislative Proposals: Approval A. Upon receipt of a proposal, the Planning Committee may: la. Approve the proposal in whole or in part. b. Request necessary legal draft preparation by Corporation Counsel. c. Transmit the proposal to the Mayor for comment. d. Determine whether the proposal should be included within the HSAC Legislative Package or the Hawaii County Legislative Package. 2. Defer for further study. 3. Reject the proposal. r 0 0 B. Conceivably, a proposal could be included in one of the following: 1. HSAC 2. Council/Administration - Proposed bills receiving Council approval and the concurrence of Administration. 3. Hawaii County Council - Proposed bills approved by a majority vote of the Council. 4. Individual Councilmembers - A proposal that has been rejected by HSAC, Administration and the Council may be lobbied for by an individual councilmember provided the proposal is submitted in the name of that councilmember and does not conflict with the legislative objectives of HSAC and Hawaii County. C. The Planning Committee may schedule additional meetings thereafter for the purpose of furthering the Legislative Package. D. The Planning Committee Chairman shall set and transmit the final deadline date for proposal submittal. III. Legislative Proposals: Submittal A. Hawaii State Association of Counties (HSAC) - The Council shall transmit the approved legislation to the HSAC Legislative Committee for disposition. -2- i o 0 B. County of Hawaii - Big Island's State legislators will be formally contacted by the Planning Committee Chairman or delegated Councilmember(s) to furnish assistance for the County Council's Package during the session. The Council may also, in joint sponsorship with the Administration, organize a meeting with State legislators of the Big Island prior to the opening of the session for the purpose of presenting the County's package and ensuring program support. IV. Lobbying A. Hawaii County Package 1. A councilmember may lobby for those measures of special interest to that member in the following manner: a. A request to present testimony shall receive approval from the Planning Committee Chairman or the Council Chairman. The testimony, a summary report or travel requisition shall be filed with the Legislative Auditor's office. b. In order to stay abreast of all personal lobbying efforts, the results of one's efforts should be conveyed in some manner to the Planning Committee Chairman. -3- .i, 1 I V O O 2. If any lobbying effort entails the use of county funds (transportation, per diem, etc.), a summary report shall be put on file. The summary report should include date, type of lobbying, to whom the lobbying was done and the subject matter. An approved travel requisition form which includes ,adequate information on lobbying intent shall suffice in lieu of the summary report. B. HSAC Legislative Package - Procedures shall be established and implemented by the HSAC Legislative Committee. V. Coordination During the Legislative Session A. The Legislative Auditor's office will serve as a repository for legislative resource materials. The progress of a specific bill may be monitored at the written request of any councilmember. B. A status report on bills may be provided as appropriate. C. When action on a bill requires immediate attention and procedural flexibility, the Planning Committee Chairman or the Council Chairman will make a decision with a follow-up memorandum to Councilmembers, if necessary. D. Final wrap-up and evaluation will be submitted by the Planning Committee following the close of session. -4- . -~- O C VI.
