Resolution
WHEREAS, Section 5-2.5 of the Hawaii County Charter enables the
County Council, by two-thirds vote of its entire membership, to
authorize the employment of special counsel for any special matter
presenting a real necessity for such employment; and
WHEREAS, Affiant Henry A. Ross filed an Affidavit of Complaint
with the Board of Ethics of the County of Hawaii against
Councilmembers James L. K. Dahlberg, Frank De Luz, III, Spencer K.
Schutte and Stephen K. Yamashiro in the matter of breaches of the
Code of Ethics; and
WHEREAS, the Board of Ethics, after formal hearings duly
conducted, dismissed the charges in the matter of breaches of the
Code of Ethics brought against the Councilmembers.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it finds the matter of breaches of the Code of Ethics of
the County of Hawaii brought against Councilmembers to be a special
matter presenting a necessity to employ special counsel.
BE IT FURTHER RESOLVED that the Council, pursuant to provisions
of Section 5-2.5, Hawaii County Charter, authorizes the payment of
$519.55 for the legal services provided to Councilman Frank.
De Luz, III by Mr. Jeffrey Choi, Esq. and the payment of $1,249.30
for legal services provided to Councilman James L. K. Dahlberg by
Mr. Wayne C. Metcalf, III, Esq.
