Resolution No: ( ~
WHEREAS, pursuant to Chapter 2, Article 9, Section 2, Hawaii County Code,
as amended, Disposition of Real Properiiy, provides that the County Council may
direct the Finance Director to dispose of real property in fee, by lease,
license, or permit; and
WHEREAS, the County Council by Resolution No. 126, specifically stated
that the .production of a sufficient number of housing units which are
affordable by low and moderate income households shall have the highest
priority among all development types; and
WHEREAS, it is the objective of the County to provide employee housing
within reasonable proximity to their place of employment; and
WHEREAS, Waikoloa has agreed to provide the project site
(TMK: 6-8-03: por. of 30) to the County for the purpose of developing a low
and moderate income housing project; and
WHEREAS, Jack Hall Kona Memorial Housing Corporation has been negotiating
with the U.S. Department of Agriculture's Farmers Home Administration for the
development of a 24-unit rental project under the Section 515 program
requirements; and
WHEREAS, Jack Hall Kona Mermorial Housing Corporation is a certified
non-profit organization and "Affordable Housing Developer"; and
WHEREAS, the Office of Housing and Community Development now desires to
negotiate lease terms with Jack Hall Kona Memorial Housing Corporation; and
WHEREAS, in order to assure success of the Project, the Council finds that
it is in the public interest to negotiate lease terms with Jack Hall Kona
Memorial Housing Corporation rather than to offer the lease at public auction;

NOW, THEREFORE, BE IT RESOLVEU BY THE COUNCIL OF THE COUNTY OF HAWAII,
that the Finance Director and Housing Administrator are hereby directed to
negotiate lease terms with Jack Hall Kona Memorial Housing Corporation to
further the development of the Project; and
BE IT FURTHER RESOLVED that a copy of this resolution by transmitted to
the Department of Finance and the Office of Housing and Community Development.
