~dIlEREAS, by Executive Order No. 3056, dated May 13, 1981, the
Governor of the State of Hawaii set aside for a community center
facility and related public purposes the Volcano Park, containing an
area of 10.00 acres, more or less, to be under the control of the
County of Hawaii; and
WHEREAS, the Volcano Community Association, a non-profit
organization exempted from federal income tax by the Internal
Revenue Service, pursuant to Internal Revenue Code §501 (c) (4), is
desirous of leasing said real property, subject to the control of
the County of Hawaii, for the purpose of developing, constructing,
maintaining, and operating a Volcano Community Activity Center on
the property to be made available for public use and recreation; and
WHEREAS, the County of Hawaii is desirous of leasing the
property to the Volcano Community Association for such purposes in
order to reduce the County's financial burden in operating public
park facilities, and County of Hawaii is willing to assist the
Volcano Community Association in the construction of said Volcano
Community Activit;! Center to the extent of furnishing necessary
materials and supplies for such construction; and
WHEREAS, County of Hawaii and Volcano Community Association
intend that the operation and maintenance of the Volcano Community
Activity Center shall be conducted at no cost or expense to the
County and, if possible, at a minimum net cost or expense to Volcano
Community Association, and the County of Hawaii and the Volcano
Community Association intend to cooperate in determining the most
appropriate fee and use policies in achieving such goals.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that in accordance-with Chapter 2, Article 19, Hawaii County
Code 1983, as amended, the County Director of Finance is hereby
directed to negotiate a lease of those public lands set aside for
the Volcano Park to the Volcano Community Association for purposes
of constructing, operating, and maintaining the Volcano Community
Activity Center.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
transmit copies of this Resolution to the Mayor of the County of
Hawaii, Director of Parks & Recreation, Finance Director and to the
Volcano Community Association.
