HomeMy WebLinkAboutRES 872 Draft 01 1980-19845 i 1~1 5 ~~ OFFICE INFORMATION ONLY Meeting: March 28, 1984 CPC) Action: Receive and file Re: Res. 872/C-1491.1 County of Hawaii-State of Hawaii Resolution No. s~2 s~ RESOLUTION AMENDING RESOLUTION N0. 2-80, ADOPTED ON DECEMBER 1, 1980, RULES OF PROCEDURE OF THE COUNCIL OF THE COUNTY OF HAWAII BY AMENDING RULE 11. WHEREAS, on January 27, 1984, the County of Hawaii, Board of Ethics tendered an Informal Advisory Opinion, stating that the Council's Rules of Procedure, 11-6, which states that "No member shall refrain from voting unless excused by the Presiding Officer. Unless excused from voting, his/her silence shall be recorded as an affirmative vote," if applied improperly could cause ethical dilemmas for members of the Council; and WHEREAS, the Board of Ethics believes that if a Council member wishes to refrain from voting because of a possible conflict of interest, that that member should be allowed to remain truly neutral. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it concurs with the Board of Ethics opinion that a Council member who wants to refrain from voting, should be permitted to do so under certain circumstances, therefore Rule 11-6 and 11-7 be amended to read as follows: 6. No member shall refrain from voting unless excused by the presiding Officer. [Unless excused from voting, his/her silence shall be recorded as an affirmative vote.l a. A member may vote "Kanalua" (undecided) or pass the first time the membec's name is called by the Clerk on any vote; but if the member; votes "kanalua" or remains silent the second time the member is' called; the member's vote will be recorded as "aye". 7. Any member who knows that he/she has a personal interest, direct or indirect in any action proposed or pending before the Council shall disclose such interest prior to the taking of the vote thereon. a. The presiding Officer shall excuse a member who has a potential monetary interest in the question, or whose right t a seat in the Council will be afected by the question, or whose official conduct is involved in the question. 8. Whenever the ayes and noes are called, no one shall be permitted to expain his/her vote. After the announcement of the result, no one shall be permitted to change his/her vote. y a BE IT FURTHER RESOLVED THAT THIS RESOLUTION SHALL TAKE EFFECT UPON ITS APPROVAL.
