Resolution
WHEREAS, pursuant to County Charter Section 3-14 interim amendments
to the Salary Ordinance may be by resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that the Salary Ordinance is hereby amended for the following department:
SECTION 8.13. DEPARTMENT OF LIQUOR CONTROL.
1. Add one new position of Liquor Control Investigator II
SR-18.
BE IT FURTHER RESOLVED that a copy of this resolution be transmitted
to the departments of Liquor Control, Finance and Civil Service for their
information.

The West Hawaii district is presently assigned two liquor investigators to work a
three-shift schedule, covering 76 liquor licensees in North and South Kona including
Milolii. Their job duties include on-premises inspections, investigations of liquor
violations, examinations for managers, ori-premises refresher clinics, reports on liquor
license applications. The workload per man is inequitable and results in inadequate
service to the Kona district. The addition of new personnel will increase efficient
coverage; provide better office services for .daily needs of licensees, and allow the
department to consider increase in geographic area to include Kawaihae, Hawaii.

LIQUOR CONTROL INVESTIGATOR I & II
Duties Summa
Inspects premises where intoxicating liquors are manufactured, sold
and/or consumed and enforces applicable State and local liquor laws, rules and
regulations; investigates a.ppa.rent or suspected liquor law violations and pre-
pares reports on findings; and performs other related duties as required.
Di,^>tinmzishin~ Characteristics:
These classes differ from the Liquor Control Investigator III in that
the Liquor Control Investigator I and II perform inspectional and investigative
tasks relative to the enforcement of liquor laws, rules and regulations; whereas
the Liquor Control Investigator III supervises and participates in such activi-
ties on an assigned shift, and conducts investigations regarding the issuance,
transferral and renewal of liquor licenses a.nd permits.
Grade Level Standards:
Grade I: This level is characterized by performing inspectional tasks
within an assigned geographical area. to enforce liquor laws, rules and regula-
tions, and by conducting irnrestiga,tions primarily involving observed or apparent
liquor law violations.
Grade II: This level is characterized by performing inspectional
tasks within an assigned geographical area, to enforce liquor laws, rules and
regulations, a.nd by conducting the more complex investigations involving alleged
or suspected liquor law violations where there is greater requirement for follow-up
and the development of £act~s, evidences and conclusions. A position at this level
may also act as team leader when two or more persoptiel are deployed on special
assignments. "
Illustrative Examples of Works
Conducts periodic inspections of licensed liquor establishments and
enforces State liquor laws a.nd the rules and regulations of the Hawaii Liquor
Commission; observes and ascertains whether licensees are complying with terms
and conditions of their respective licenses; checks for liquor law violations
such as serving liquor to minors, to persons a.t the time under the influence of
liquor, and to persons known by the licensee to be addicted to the excessive use

of liquor; checks on the sale, service, or consumption of liquor on or within
any licensed premises before or after hours established by the Liquor Commission,
the sale or offer of sale of a, drink which contains less than one fluid ounce of
liquor, employees consuming liquor while on duty or any other misconduct of
employees, the "stacking" of liquor for consumption by patrons, the possession
of liquor by a licensee other than that authorized by the license, the selling
or serving of liquor by the licensee or his employees outside of the licensed
premises, etc.; checks entertainment in licensed premises to see that the condi-
tions of entertainment permits are carried out, and that amusement devices or
equipment on premises are properly licensed; boards vessels in port and checks
for compliance with liquor laws, rules and regulations; initiates and conducts
investigations of apparent or suspected liquor violations which may involve the
examination of business records and books, the interviewing of witnesses and
principal parties, and the seizure of physical evidence; prepares reports on
findings and cites pertinent provisions of laws or rules violated; may operate
a.s member of a.. team on special assignments such as for stakeouts, surveillance
of trouble spots, and sitnilar occasions where two or more positions have to be
deployed; serves subpoenas to witnesses and testifies before the Liquor Control
Adjudication Board or in court; resolves minor discrepancies with licensees and
interprets and explains applicable liquor laws and rules to licensees and other
interested persons; prepares and submits activity reports of work tours; may
exercise power of arrest a.s circumstances warrant.
Minimum Qualification Requirements:
Training and Experience: A combination of education and experience
substantially equivalent to graduation from high school and
Grade I: two years of inspectional or investigative work experience
relating to the enforcement of laws, ordinances and/or rules and regulations.
Grade II: three years of inspectional or investigative work experience
relating to the enforcement of laws, ordinances and/or rules and regulations,
one of which shall have been in a, liquor law enforcement program.
License Requirement: Possession of a valid motor vehicle operator's
license.
Knowledge of: laws, rules and' regulations governing the manufacture,
importation and sale of liquors in the County of Hawaii; principles and techniques
of inspection a.nd investigation applica.ble.to the work involved; standard methods
used by business establishments for keeping records; rules of legal evidence and
laws of ,arrest; court procedures; functions and jurisdiction of other enforcement
agencies. ,.
Ability to: interpret and explain laws, rules and regulations; meet
and deal effectively with a wide variety of people and elicit necessary informa-
tion, gather, verify, and evaluate facts and evidence; prepare clear and concise
reports; operate a typewriter .and a. sound level meter and calibrator.

Persons seeking appointment to positions in this class must meet the
health and physical condition standards deemed necessary and proper for
performance of the duties.
This is the first specification approved for the new classes,
LIQUOR CONTROL INVESTIGATOR I & II.
