RESOLUTION ALLOWING THE GRANTING OF AN ACCESS EASEMENT OVER
PARCEL L-6, TMK 1-2-04-90.
WHEREAS, the County of Hawaii is the owner of Parcel L-6, described as
TMK (3) 1-2-04-090, which was created for the proposed county park extension under
the Kaimu-Pahoa road project, and which was originally acquired by the County
in 1970; and
WHEREAS, at the time the County acquired the subject parcel, a reservation for
an access easement was no[ reserved for Mr. James Ahia, Sr., from whom the property
was acquired; and
WHEREAS, while the Ahias have enjoyed physical use of an access over the
County's property, there is no legal access to their property at this point in time, thereby
landlocking the Ahia parcel described as Tax Map Key (3) 1-2-04-085; and
WHEREAS, a reservation of an access easement should have been granted at the
time the County acquired the property.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY OF HAWAII that in order to
correct the oversight at the time of the original acquisition, the County of Hawaii does hereby grant to
the current owner, James K. Ahia, III, his heirs, personal representative, administrators, and assigns,
the right of an access easement across the parcel described as L-6, under the conditions set forth in
the Grant of Easement attached hereto.
BE IT FURTHER RESOLVED that the County Clerk be and is hereby instructed to transmit
copies of this resolution to the Department of Parks and Recreation, the Director of Finance, the
Department of Public Works, Mr. James K. Ahia, III, and Gerald Takase, Deputy Corporation
Counsel.
