AN ORDINANCE AMENDING CHAPTER 24 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO VEHICLES AND TRAFFIC. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this amendment is to address a need to provide more time for loading and unloading activities, as the current five-minute allotment, on average, has proven to be inadequate. SECTION 2. Chapter 24, article 8, division 3, section 24-212.1 (Standing in active loading and unloading zones), paragraph (a), of the Hawaii County Code 1983 (2005 Edition, as amended), is amended to read as follows: "(a) No person shall stop, stand or park a vehicle for any purpose or length of time other than for the expeditious loading or unloading of passengers or for the expeditious unloading and delivery or pickup and loading of materials in any place marked as an active loading and unloading zone during hours when the regulations applicable to such active loading and unloading are effective, and then only for a period not to exceed [five] fifteen minutes." SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed material and stricken material and underscoring need not be included. SECTION 4. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
