Re: Operating Budget
Last fiscal year, the State of Hawai'i Department of Transportation had awarded a
$80,000 DUI & Crash Reconstruction Traffic Safety Training grant to the Hawai'i Office
of the Prosecuting Attorney. These funds, derived from federal funds, were to be used to
implement a project that included: assignment of a deputy prosecuting attorney to be the
Statewide Traffic Safety Resource Prosecutor, providing statewide training for police and
prosecutors, and for participation at monthly statewide traffic commanders meetings.
However, only $50,000 of the $80,000 total grant amount was appropriated in last fiscal
year's budget. To fully implement and complete this project, the Prosecutor's Office
seeks to appropriate the remaining $30,000 into this fiscal year's budget.
Enclosed is a bill for an ordinance amending this fiscal year's Operating Budget and
increasing the DUI & Crash Reconstruction Traffic Safety Training account by $30,000
and bringing the total grant appropriation to $80,000.

A. REQUEST:
1) Requesting a bill for an ordinance to appropriate an additional $30,000 for the DUI & Crash
Reconstruction Traffic Safety Training account.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The Prosecuting Attorney's Office was been awarded $80,000 from the State of Hawaii Department of
Transportation to implement a project that includes: assignment of a deputy to be the Statewide Traffic
Safety Resource Prosecutor, providing statewide training for police and prosecutors, and for participation at
monthly statewide traffic commanders meetings.
In fiscal year 2009 we had $50,000 appropriated. We need an additional $30,000 appropriated so we may
fully implement this project aimed at improving highway safety.

the mission/goal of the prosecutor's training project is to make our roads safer and improve the performance of the
aw enforcement system in its efforts to enforce traffic laws by holding inter-agency meetings between police and
)rosecutors and training deputy prosecuting attorneys in the conceptual, technical, scientific and trial aspects of
hese offenses.
STRATEGIES
• Continuing to have a designated State wide Traffic Safety Resource Prosecutor, who will coordinate traffic
related training for prosecutors and police in the State of Hawaii and who be available to answer traffic
related questions form other deputy prosecutors in the State of Hawaii.
• Have the Traffic Safety Resource Prosecutor attend every traffic commanders meeting.
• Have the Traffic Safety Resource Prosecutor and a deputy prosecutor who co-chairs the Governor's Highway
Council attend the Lifesavers conference in Nashville, Tennessee in March of 2009 and other traffic related
trainings and/or events.
• Conduct a two-day state-wide training on Hawaii's DUI traffic laws with a focus on technological tools
available for police in investigating traffic crimes, prosecutors in evaluating and presenting cases and the
judiciary in sentencing of traffic crimes.
• Train at least 20 deputy prosecutors who handle traffic cases from around the state.
• Train police officers who handle traffic case from around the state.
SOLUTION/IMPLEMENTATION
• Implementation will include flying in at least 2 expert trainer/consultants from the mainland to help in the
presentation of the trainings.
• Implementation also includes flying in at least 2 experienced local trainers/consultants from the State of
Hawaii, to help in the presentation of the training courses.
• Implementation also includes flying in and housing at least 10 local deputy prosecutors from around the state
to be trained.
• Other expenses include flying deputy prosecutors to neighbor islands and the mainland to attend the Traffic
Commanders meetings and the Lifesavers Conference.
• Other expenses also include preparation of written materials and training room expenses.
EVALUATION
• The goal is to train at least 20 Deputy Prosecuting Attorneys from around the State of Hawaii and expose
them to technological tools that are currently available in the prosecution of traffic crimes. The police
officers in attendance will also be exposed to technology that is or will be available in the near future which
can be used both during the investigation of traffic crimes and in the prosecution of traffic crimes.
• Participants will fill out a survey designed to measure the benefits of the training process, the amount of
information or knowledge gained as a result of their participation, the usefulness of the material covered, and
the likelihood of such being applicable to cases they encounter-

During the two day training participants will practice using various courtroom tools.
• Continue collaborative efforts in prosecution of traffic related offenses from investigation through
sentencing.
