WHEREAS, MAUNA KEA AGRIBUSINESS CO., INC., a Hawaii corporation, is the owner of portions of the Kaupakuea Homestead Road located in Makahanaloa, South Hilo, Hawaii, specifically identified as Tax Map Keys (3)2-8-03-001 (portion), 2-8-04-001 (portion), and 2-8-07-003 (portion), being more pazticulazly described in Exhibit "A" and delineated on Exhibit "B" attached hereto; and WHEREAS, MAUNA KEA AGRIBUSINESS CO., INC., the KAUPAKUEA HOMESTEAD ASSOCIATION and the County have constructed all roadway improvements in accordance with the agreement set forth in Resolution 294 adopted Apri] 17, 1996; and WHEREAS, MAUNA KEA AGRIBUSINESS CO., INC. and the KAUPAKL'EA HOMESTEAD ASSOCIATION have received approval from the County of Hawaii's Department of Public Works, Department of Water Supply and the Planning Department for the improvements made to the subject property, as shown in Exhibits "C," "D" and "E," and are desirous of dedicating the subject parcels to the County of Hawaii for road and drainage purposes; and WHEREAS, the subject road and drainage improvements have been completed and aze in acceptable condition for dedication; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council may accept gifts which include the dedication of land on behalf of the County of Hawaii; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication deed for real property identified as Tax Map Keys (3)2-8-03-001 (portion), 2-8-04-001 (portion), and 2-8-07-003 (portion), for road and drainage purposes.
