Home My WebLink AboutRES 031 Draft 03 1998-2000 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 99 (DRAFT 3) RESOLUTION ACCEPTING THE DEDICATION OF ROADWAY LOTS WITHIN SUNRISE RIDGE INCREMENT II SUBDIVISION FROM SUNRISE RIDGE II PARTNERS, TAX MAP KEYS (3)2-3-43-010, 2-4-67-039, and 2-4-67-040, TO THE COUNTY OF HAWAII. WHEREAS, SUNRISE RIDGE II PARTNERS, a Hawai i joint venture, is the developer of Roadway Lots A, B, 138-B, 376 and 393 in the Sunrise Ridge Increment II Subdivision and the owner of those certain roadway lots located in South Hilo, Hawai i, specifically identified as Tax Map Keys (3)2-3-43-010, 2-4-67-039, and 2-4-67-040, being more particularly described in the dedication deed (Exhibit 1) and delineated on the map (Exhibit 2) attached hereto; and WHEREAS, Sunrise Ridge 11 Partners, the developer, has constructed all subdivision improvements and received final subdivision approval; and WHEREAS, Sunrise Ridge II Partners has received approval from the County of Hawai'i's Department of Public Works, Department of Water Supply and the Planning Department for the improvements made to the subject property, and is desirous of dedicating the subject parcels, including all improvements thereon, to the County of Hawai i for road, drainage, and sewer purposes; and WHEREAS, the subject road, drainage and sewage improvements have been completed according to County of Hawaii standards, are in acceptable condition for dedication, and in full compliance with the provisions of Chapter 23 of the Hawai i County Code; and WHEREAS, Section 23-10 of the Hawaii County Code requires that the acceptance of such road, drainage and sewage improvements be in full compliance with the provisions of Chapter 23 of the Hawaii County Code; and WHEREAS, Article XIII, Section 13-12 of the Hawai i County Charter, provides that the Council may accept gifts which include the dedication of land on behalf of the County of Hawaii; NOW, THEREFORE, BE 1T RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 ofthe HawaYi County Charter and Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the real properties described in the attached dedication deed (Exhibit 1) and more specifically identified as Tax Map Keys (3)2-3-43-010, 2-4-67-039, and 2-4-67-040, including all improvements thereon, for public road, drainage, and sewage purposes.
