BE'IT-RESOLVED'BY THE COUNCIL OF THE COUNTY OF HAWAII: I. That it is necessary, for the public use and purpose, to wit: for the widening and improvement.of the Pahoa-Kapoho Road Improvement Project, Phase II, District of Puna, County and State of Hawaii, to take, acquire, and condemn certain lands with all improvements thereoa_and appurtenances'thereunto belonging, in fee simple aboolute,.free and clear of .all liens and encumbrances, hereinafter described and to that end and for these purposes the Corporation Counsel of the County of Hawaii -be -and -be -is hereby authorised and empowered to initiate proceed- ings in eminent domain, as provided by law, for the taking, acquisition and con- -demnation-of the lands described in Exhibits A, B and C attached hereto and made a part hereof. II. That in the process of saidproceedingsin eminent domain, said Corporation Counsel be and he is hereby authorised and empowered_to negotiate terms of settlement; subject.to the approval of this Council and of the Court before which such proceedings are prosecuted.
