Resolution No. '1911
WHEREAS, Chapter 2, Article 9, Section 2.A, Hawaii
County Code, as amended, provides that the County Council may
by resolution approved by a majority of its members, direct
the Director of Finance to issue permits for the temporary
occupancy of County -owned lands; and
WHEREAS, the property owned by the County of Hawaii
(adjacent to the former Ookala School) situated at Ookala,
Hawaii, TMK: 3-9-01:26 containing an area of .363 acres,
and as shown on Exhibit "A" attached hereto, is not being
utilized and is considered surplus to County needs; and
WHEREAS, Theo. H. Davies & Co., Ltd., dba. Davies
Hamakua Sugar Company, hereinafter referred to as "Plantation",
desires to utilize the hereinabove described property to
expand its factory operations,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that, in accordance with the provisions of
Chapter 2, Article 9, Section 2.A of the Hawaii County Code,
as amended, the Director of Finance be authorized to issue a
month to month permit to Plantation expiring on June 30, 1981
for the temporary use of the land described in Exhibit "A!'
for expansion of its factory operations. The Director of
Finance shall determine terms and conditions of the permit.
BE IT FURTHER RESOLVED that prior to the expiration
date of the temporary permit, the Director of Finance shall
dispose of the property by exchange, as provided in Article 9,
Chapter 2, of the Hawaii County Code.
