Pursuant to Section 92-5(a)(4), Hawaii Revised Statutes, as amended, we
request attorney-client confidential discussion in executive session to consult
with the County Council on questions and issues pertaining to its powers, duties,
privileges, immunities and liabilities regarding the status of the appeal and
matters relating to the construction of the Mamalahoa Highway Bypass in the
above-entitled matters. We ask that this case be placed on the council's agenda
