RESOLUTION N0. ~1 99
RESOLUTION AUTHORIZING THE COUNTY OF HAWAII TO ENTER INTO AN
AGREEMENT WITH THE STATE OF HAWAII PURSUANT TO HAWAII REVISED
STATUTES SECTION 46-7 WHEREBY THE STATE OF HAWAII DEPARTMENT
OF TRANSPORTATION AND THE FEDERAL TRANSIT ADMINISTRATION
ENABLE THE COUNTY OF HAWAII TO RECEIVE FUNDS MADE AVAILABLE
THROUGH UNITED STATES CODE TITLE 49, CHAPTER 53, SECTION 5311.
WHEREAS, the United States Department of Transportation, Federal Transit
Administration has designated the State of Hawaii Department of Transportation to
administer the funding of county projects with federal funds; and
WHEREAS, the County of Hawaii, as a subrecipient of these funds desires to
secure and utilize fund grants to meet the general public transportation needs and the
special transportation needs of the elderly and disabled citizens of the County; and
WHEREAS, the County of Hawaii wishes to enter into an agreement with the
State of Hawaii whereby the State Department of Transportation shall provide the County
of Hawaii, as subrecipient, with funds to provide transportation services to the general
public and to provide transportation services to the elderly and the disabled.
WHEREAS, Section 46-7 of the Hawaii Revised Statutes, as amended, requires
that County Departments obtain the consent of the County Council to enter into
agreements with the federal or state governments respecting action to be taken pursuant to
any powers granted by law to furnish, expend and receive any funds or other assistance in
connection with projects being or to be undertaken pursuant to those powers.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII, that the County of Hawaii is authorized to enter into the
agreement for such federal funding through the State of Hawaii Department of
Transportation pursuant to Hawaii Revised Statutes Section 46-7.
BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is
authorized to sign the above referenced agreement and any related documents on behalf
of the County of Hawaii pursuant to the Hawaii County Charter.
BE IT FURTHER RESOLVED that the County Clerk is hereby directed to
forward copies of this resolution to the Honorable Stephen. K. Yamashiro, Mayor of the
County of Hawaii, the United States Department of Transportation, Federal Transit
Administration, the State of Hawaii Department of Transportation and to any other
interested government or governmental agency.
