Resolution No,- - 418
WHEREAS, Chapter 3, Article 2, Section 9.02, of the Hawaii
County Code, provides that every owner of land abutting on or adjoining
any public highway or street in the County of Hawaii, upon being required
by the Council of the County of Hawaii and being notified of such require-
ment, shall construct and maintain in good condition the sidewalk within
the established sidewalk area on the highway or street`adjacent to such
property; and
WHEREAS, the concrete sidewalk adjacent to Mamo Street, Punahoa
Street and Kamehameha Avenue, Hilo, County and State of Hawaii, has not
been maintained and as a result creates a hazard to the public; and
WHEREAS, the owner of land adjacent to Mamo Street, Punahoa Street
and Kamehameha Avenue is Thomas K. Lalakea,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that written notice be given to Thomas K. Lalakea by certified mail,
return receipt requested, that he is required to curb, construct and maintain
in good condition the sidewalk adjacent to Mamo Street, Punahoa Street and
Kamehameha Avenue which abuts and/or adjoins his property on Mamo Street,
Punahoa Street and Kamehameha Avenue, more particularly described as TMK:
2-3-08:20, in accordance with the provisions of Sections 265-26 to 31,
Hawaii Revised Statutes, and Sections 9.01 and 9.02, Article 2, Chapter 3,
of the Hawaii County Code; and that if said Thomas K. Lalakea shall fail to
construct, maintain and/or repair the sidewalk adjacent to his property
within sixty (60) days after receipt of notice, the Department of Public
Works, County of Hawaii is authorized to maintain and repair said sidewalk
at the expense of the owner.
BE IT FURTHER RESOLVED that the County Clerk be authorized and
directed to forward a copy of this resolution to tor. Thomas K. Lalakea
and the Department of Public Works, County of Hawaii.
