RESOLUTION NO. 84 99
RESOLUTION ACCEPTING THE DEDICATION OF ROADWAY LOTS WITHIN SUNSET
RIDGE AT WAIKOLOA, PHASE III, UNIT 1, INCREMENT 2, FROM SUNSET RIDGE
JOINT VENTURE, TAX MAP KEY (3)6-8-32-046 (PORTION), TO THE COUNTY OF
HAWAII.
WHEREAS, SUNSET RIDGE JOINT VENTURE, a Hawaii general partnership, is the
developer of Sunset Ridge at Waikoloa, Phase III, Unit 1, Increment 2, and the owner of those
certain roadway lots located in Waikoloa, Hawaii, specifically identified as Tax Map
Key (3)6-8-32-046 (portion), being more particularly described in Exhibit A and delineated on
Exhibit B attached hereto; and
WHEREAS, Sunset Ridge Joint Venture has constructed all subdivision improvements as
required for final subdivision approval; and
WHEREAS, Sunset Ridge Joint Venture has received approval from the County of
Hawaii's Department of Public Works, Department of Water Supply and the Planning
Department for the improvements made to the subject property, and aze desirous of dedicating
the subject pazcels to the County of Hawaii for road and drainage purposes; and
WHEREAS, the subject road and drainage improvements have been completed according
to County of Hawaii standazds and aze in acceptable condition for dedication; and
WHEREAS, Section 23-10 of the Hawaii County Code requires that the acceptance of
such road and drainage improvements be in compliance with Chapter 23 of the subdivision code;
and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the
Council may accept gifts which include the dedication of land on behalf of the County of Hawaii;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and
Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication deed
for real property identified as Tax Map Key (3)6-8-32-046 (portion) for road and drainage
purposes.

EXHIBIT "A"
All of those certain parcels of land situate at Waikoloa, District of South Kohala,
Island and County of Hawaii, State of Hawaii, being a portion of Royal Patent 5671, Land
Commission Awazd 8521-B, Apana 1 to G. D. Hueu, being more particulazly described as follows:
LOT 47, area 19,568 squaze feet, more or less; and
LOT 48, azea 27,403 squaze feet, more or less;
of the "SUNSET RIDGE AT WAIKOLOA, PHASE 3, UNIT 1 as showm on File Plan No. 2213,
filed in the Bureau of Com evances of the State of Hawaii.
Together with all rights and privileges conferred upon owners of lots within the
Waikoloa Village Subdivision by that certain Declazation of Protective Covenants, Conditions and
Restrictions dated May 27, 1971, recorded in the Bureau of Conveyances of the State of Hawaii in
Liber 7577 at Page 66, as now or hereafter amended and supplemented (the "Declazation"), the
aforementioned property being made subject thereto by supplemental Declazation dated Mazch 1,
1990, recorded as Document No. 90-029591; and
Being a portion of the land conveyed to Sunset Ridge Joint Venture, a Hawaii
general partnership, by Deed dated October 19, 1990, recorded in the Bureau of Conveyances of the
State of Hawaii as Document No. 90-1 63 1 44.
Subject, However, to:
1. Reservation in favor of the State of Hawaii of all mineral and metallic mines.
2. An easement for electrical purposes, in favor of Hawaii Electric Light Company,
Inc., a Hawaii corporation, dated November 24, 1997, recorded on April 29, 1998, in the Bureau of
Conveyances of the State of Hawaii as Document No. 98-059335, in, over and across the pazcels
herein described.
3. An easement for construction, installation, reinstallation, operation, maintenance,
repair and removal of a water system, in favor of Waikoloa Water Co., Inc., a Hawaii corporation,
dated ,recorded on , in the Bureau of Conveyances of the State
of Hawaii as Document No. , in, under and across the pazcels herein described.
