STATE OF HAWAII ..J __ _', RESOLUTION NO. 228 09 RESOLUTION ACCEPTING THE DEDICATION OF PARK SITE, BEING TAX MAP KEY: (3)2-7-040:010, SITUATE AT PAUKA`A, DISTRICT OF SOUTH HILO, COUNTY AND STATE OF HAWAII, FROM HILO ONE, INCORPORATED. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, Hilo One, Incorporated is the owner of a parcel in the Honoli`i Place Subdivision, containing an area 2.003 acres, identified as Tax Map Key: (3)2-7-040:010, situate at Pauka`a, in the District of South Hilo, County and State of Hawaii, described in Exhibit "A" and delineated on Exhibit "B" attached hereto; and WHEREAS, Hilo One, Incorporated is desirous of dedicating the subject parcel, including all improvements thereon, to the County of Hawaii for park purposes, in compliance with Condition I of Ordinance No. 96-121, and the improvements have been inspected and approved by the County of Hawaii Planning Department and the Department of Parks and Recreation; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`1, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the County of Hawaii accepts the parcel in the Honoli`i Place Subdivision, containing an area 2.003 acres, identified as Tax Map Key: (3)2-7-040:010, including all improvements thereon, for park purposes. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) the Department of Parks and Recreation; (3) Deputy Corporation Counsel Gerald Takase; and (4) Alan M.
