SUBJECT: RESOLUTION FOR GRANT OF EASEMENT
EXTENDING SUNSET DATE
We request the Council's approval for this resolution to extend the sunset date for the
Grant of Non-Exclusive Easement with 1250 Oceanside Partners to March 2010.
Without the extension public use of the Mamalahoa Bypass Phase 1 through the
intersection with the Haleki'i Street Extension will end on September 4, 2009. Our assessment
has shown that opening the Haleki'i Street Extension to the general public for one-way
southbound travel has provided the intended benefit by significantly easing traffic congestion at
peak hours. The Department of Public Works believes that an additional six months is
warranted, and will provide relief to area motorists until a permanent solution is implemented.
We request that this matter be waived from committee, as enactment prior to September
4, 2009, is crucial.

RE: Resolution, Bill or Communication No. 231-09 (Proposed Resolution Authorizing
and the Extension of the Grant of Non-Exclusive Easement for Limited Public Access
over Private Roadways for Temporary Mamalahoa Bypass Through Hokuli`a Phase I and
Haleki'i Street, In the Districts of North and South Kona, Island, County and State of
Hawai' i)
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai'i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Public Works and Intergovernmental Relations to the full
Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore
advantageous that approval is granted and the matter placed onto the next Council agenda for
review. However, in the event this request is denied, for whatever reason, I understand the
matter shall be referred to the Committee on Public Works and Intergovernmental Relations for
placement on its future agenda.
