Resolution
WHEREAS, a portion of the County maintained road at Ahualoa
Homestead, Ahualoa, Hamakua, Hawaii, is not within the road right-
of-way (See Exhibit A - Parcel 1 - Area shaded in red on attached
map) but encroaches into the property owned by Brilhante-Hawaii,
Inc. (See Exhibit A - Parcel 3 - Area shaded in yellow on attached
map),-
WHEREAS,
ap);
WHEREAS, the purpose of land exchange between Brilhante-Hawaii
Inc., and the County of Hawaii is to define and establish the
property line of County maintained road;
WHEREAS, County of Hawaii will convey in fee simple to
Brilhante-Hawaii, Inc., a parcel of land containing an area of
0.253 acres and, in return, Bilhante-Hawaii, Inc., will convey in
fee simple, to the County of Hawaii a parcel of land containing an
area of 0.268 acres.
WHEREAS, it is mutually agreed between Brilhante-Hawaii, Inc.,
and the County of Hawaii that no monetary consideration shall be
involved in the exchange;
WHEREAS, the State of Hawaii has conveyed Parcel 1 to the
County to effectuate the exchange;
WHEREAS, Chapter 2, Article 9, Hawaii County Code, as amended,
allows the exchange of County -owned property for private property
for public purposes;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that it approves and authorizes the Mayor to enter into
a land exchange with Brilhante-Hawaii, Inc.;
BE IT FURTHER RESOLVED that the County Clerk be authorized
and directed to forward a copy of this Resolution to Brilhante-Hawaii,
Inc., and to the Department of Public Works and the Director of
Finance of the County of Hawaii.
