Resolution No. 325
PROVIDING FOR THE ACQUISITION OF LANDS AND DRAINAGE
EASEMENTS FOR THE WAILUKU-ALENAIO WATERSHED DIVERSION
NO. 4 PROJECT, JOB NO. P-2245, PUNAHOA 1ST AND 2ND,
DISTRICT OF SOUTH HILO, COUNTY AND STATE OF HAWAII.
WHEREAS, Resolution No. 273 authorized the Corporation
Counsel of the County of Hawaii to initiate proceedings in
eminent domain or to negotiate settlements for the acquisi-
tion of lands and drainage easements for the Wailuku-Alenaio
Watershed Diversion No. 4 Project, Job No. P-2245, Punahoa lst
and 2nd, District of South Hilo, County and State of Hawaii;
and
WHEREAS, Exhibits A, B and C, attached to said Resolution
and made a part thereof, contain inaccuracies; and
WHEREAS, a change in the construction plans for the
subject project requires the acquisition of additional lands
and drainage easements;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that Resolution No. 273, duly adopted by
the County Council of the County of Hawaii on July 1, 1978,
is hereby rescinded; and
BE IT FURTHER RESOLVED that it is necessary for public
use and purpose, to wit: Providing for the acquisition of
lands and drainage easements for the Wailuku-Alenaio Watershed
Diversion No. 4 Project, Job No. P-2245, Punahoa 1st and
2nd, District of South Hilo, County and State of Hawaii, to
take, acquire and condemn said lands in feesimple, together
with drainage easements appurtenant thereto, hereinafter
described, including all improvements thereon and appurtenances
thereunto belonging, free and clear of all liens and encumbrances,
and to that end and for these purposes, the Corporation
Counsel of the County of Hawaii be and he is authorized and
empowered to initiate proceedings in eminent domain, as
provided by law, for the taking, acquisition and condemnation
of the following lands and drainage easements more particularly
described in Exhibits A through H, attached hereto and made
a part hereof.
BE IT.ALSO RESOLVED that in the process of said proceedings
in eminent domain, said Corporation Counsel be and he is
hereby authorized and empowered to negotiate terms of settlement,
subject to the approval of this Council and of the court
before which such proceedings are prosecuted.
